Tenure status of certificated employees when status of district is changed. Applies in cases of annexation, uniting, unionization, and unification.
Substitutes may be employed from month to month. Salary schedule may be adopted for substitutes.
Tenure status on formation of unified school districts.
RIGHTS AND DUTIES.
Upon the request of a governing board of school trustees the district attorney must defend any employce
or former employee of the school district in case of suit brought against such employee for an act
performed in the course of his employment.
Teachers not liable for injury or death of pupils while participating in any school activity unless
negligence of teacher is proximate cause of death or injury.
School boards have power and it is their duty to fix and prescribe the duties of employees.
Teachers refusing or wilfully neglecting to make legally required reports are guilty of misdemeanor and
subject to fine.
Teachers must file certificates before teaching.
Teachers must notify county superintendent of day of opening or closing school at least one week in
advance. School boards must notify teachers of intention to close school at least two weeks in advance.
Teachers’ salaries must be withheld until notice has been given of closing school.
Teachers must enforce course of study, the use of legal textbooks and prescribed rules and regulations.
Teachers are responsible for conduct of pupils on the way to and from school, on the playgrounds, and
during recess.
Teachers must keep state school register, leaving therein a copy of the program of recitations and the
classification and grading of all pupils. Teacher’s warrants must be withheld until clerk of board has
filed a certificate that the teacher has kept state school register in accordance with law.
Teachers required to make annual report on blanks prescribed by the Superintendent of Public Instruction.
Teachers leaving school before the close of the school year must make report to county superintendent
of schools. Teachers employed at the close of school must report for the entire school year regardless
of any previous report for a part of the year by another teacher. Salary warrants must be withheld if
annual report has not been filed and approved.
Salary warrants must be withheld unless teachers have faithfully performed all the duties prescribed.
Persons abusing teachers in the presence or hearing of pupils are guilty of misdemeanor and subject to fine.
All teachers are required to attend teachers institute and shall receive regular salary during time of
attendance upon institute.

Teachers are required to be present in their school rooms at least thirty minutes before the time prescribed
for commencing school unless the school board provides otherwise by special resolution.
Teachers must observe punctually hours fixed by school board for opening and closing school.
Fire drill must be held at least once in each school month.
Teachers are responsible for the conduct of children at school and on the way to and from school.
Teachers are responsible for sanitary, neat, and cleanly condition of school premises.
Teachers must keep register of applicants for admission after classes are full.
Satisfactory explanation may be required for absence or tardiness.
RESIGNATIONS AND DISMISSALS.
School board must accept resignations and fix the time, not later than the close of the school year, when
such resignations shall take effect.
Permanent teacher may be dismissed only for cause and after a fair and impartial public hearing.
Causes for dismissal are: immoral or unprofessional conduct; commission or aiding or advocating the
commission of acts of criminal syndicalism; dishonesty; incompetency; evident unfitness for services
physical or mental condition unfitting him to instruct and/or associate with children; persistent
violation of or refusal to obey the school laws of California, or reasonable regulations prescribed by
the State Board of Education or the governing board of the school district for the government of the
public schools.
Wilful neglect or failure to give required instruction in the United States Constitution is cause for
dismissal.
Procedure for dismissal of permanent teachers.
Probationary teachers may be dismissed during the school year for cause only, Causes are as specified in
the case of permanent employees.
Services of probationary teachers may be terminated at the close of any school year by notice given in
writing on or before the 15th of May.
In school districts having an average daily attendance of 60,000 or more, probationary employees may
be dismissed for cause only,
Substitute and temporary employees may be dismissed at any time at the pleasure of the board.
Permanent teachers may be dismissed at the close of any school year when it is necessary to decrease the
number of permanent teachers on account of decrease in attendance or on account of the discontinuance of any particular service. Teachers so dismissed shall be dismissed in the order in which
employed, except that no permanent teacher may be dismissed until after probationary teachers
have been dismissed. Such persons shall have preferred right to reappointment if the service is
reestablished or number of teachers is increased within one year and shall be reemployed in order of
original employment. Teachers so dismissed shall be given a statement of honorable dismissal.
SALARIES.
Women shall receive the same compensation as men for like services when holding the same grade
certificates.
In cities, teachers of beginners shall be ranked in the salary schedule with the highest salaried teachers in
the elementary grades of equal training and experience.
Uniform allowance may be made in any schedule of salaries for years of training or for years of service.
No salaries may be paid in violation of this law.
Teachers must be legally employed and certificates must be on file and in full force for the full time for
which salary warrants are drawn.
Teachers’ salaries may be paid by the school month or in ten or eleven or twelve equal payments.
