The People of the State of Cal. ifornia to Phillip Williams greeting: You are hereby summoned to appear and answer to the Complaint filed against you and Jesse Owen, within ten days from the service of this writ if servedon you in this County, within twenty days if served on you in this District and ont of this County, and within forty days if served on yon in this State and out of this District, in an a¢tion commenced on the tenth day of Novem. ber, A. pD. 1859, in said Court, to obtain a decree of this Court for the foreciosure of two certain mortgages, one bearing date November 19h, 1858, executed = 2 defendants to Hatfield & Howland, and the other of said mortgagve bearing date March 3d, 1359, exccuted by the said defendants to plaintiffs, and for She sale of the premises therein, and in said com. plaint particularly mentioned and described, and the application of the mouies arrising from such sale to the payment of the amount ive on three certain promisory notes, set forth in said complaint, made and delivered to said platntifis by the said defen:tants, said notes dated respectively : November 19th, 1258, March 3d, 1839 and May 4th, and thereby intended to be secured the sum of $755 25, with interest on $400 dollars at che rate of 3 per cent. per month from the date hereof until paid, and interest on the sum of $21t 76, at the rate of 24 per cent. per month from the date hereof unttt paid, and if anydeticiency shall remain after applying all of said monies properly so applicable thereto, then that plain tiffs may have execution therefor against the said deiendants ; also, that said defendants and all and every person claiming by, through or under them, . subsequently tothe date of plaintiffs mortgage and . the commencement of this action, may be barred and . foreclosed of all right, claim. lien and equity of redemption in or to the said mortgaged premises or any . part thereof, and for such other or further relief, or both, in the premises as may be just and equitable, . and for plaintiffs costs of this suit; and you are . hereby.notifie? that if you fail to answer said complaint as herein directed, plaintiffs will take judgment against you therefor by default, together with all costs of suit, and also demand of the Court such other relief as is prayed forin plaiatiifs said com . plaint . ~ S In testimony whereof I, Joun 8.
