Examination of Louls Goldburg. . ‘mony taken before Justice AXDERSON, Dec. a and. 30th, reported by ‘Gro. S. Hurr. EVIDENCE FOR THE PROSECUTION. George Thomas.—I know the Defendant, and . John Enders, There was a large gathering at Carter's house in Humbug City, eu Saturday . evening, Dec. 26th, 1857. Enders came out of . the ball room into the bar-room, and attempted to pull the room door shut, and Goldburg tied . to push it open. Enders said the dvor should . not be opened by any parties that had not paid fer their tickets. Goldburg said he should open it any how. and Euders said “Let me see you . open it.” The first Isaw then was a scuffle be. tween the two, and that raised some other scuf. fling and Goldburg ran by where 1 was aud went out into the street. The scuflling inside . eeased iv a minute or so, and Euders and [ weut down street neur to Goldburg’s house. G’s house is about 100 yards from Carter’s, on the . other side of the street I left Geldburg there and returned to Carter’s, and I think remained in the ball room two or three minutes, and went eutside again. I went to the end of the house jn front and returned towards the bar-roum, . when I saw Goldburg and another man coming back again frem towards G.’s house. G. spoke to me, and spoke of his not being admitted into the ball room; said he had paid for his ticket, . and that it was not right. I told bim thatI was . floor manager, and that if he had spoken to me he could have gotten in. I then left him and {wo more men talking on the platform, and I went into the bar room. where I bad been buta few moments when IJ heard a fuss on the outside, but I did not go out until heard Enders call out that he was cut. I then rau out aud saw E. . staggering with his hand on his side, and I ran to him and asked what was the matter. He said he was cut, cnt. I put my hand around him and helped him into the house, and then ran to the ball room and called out the Doctor. Enders was Jaid on a settee and the Doctor dressed his wound. There was ne difficulty in the bar room before Enders tried to shut the door. Iwas not present at the cutting. G. went out of the door and left directly after the cutting. Skidmore was with G. when he returaoed after the first scuffle. Cross-Examined.—Enders had not been drinking that I know of. That was a public ball at Carter's, and any respectable man whe paid tor his ticket could goin. Enders was there as an intimate friend of Mrs Carter’s, Goldburg told Endere that he bad his ticket when E. tried to pull the door shut, and E, then said that he would like to see him go in. The scuffle at the déor was over ina moment. LT went ot about two or three minutes after Goldburg had gone. Enders said be wanted to see G, when he and [ walked down towards G.’s house. He did not ray what for. Iwent along for company, Enders was at that time some little excited. We did not sce G. when we went down. Enders asked me to go back as my wife had sent for me aud I might make her uneasy if 1 went down street with him, I bad been back at the house five, tenor fifteen minutes before [saw Goldburg again. Enders had net got back to Carter’s when Goldburg rdturued after going to his house, Kaders must bave been near at hand when [entered the house. He made no threats against G. when we were going down, and did not say. in my hearing, that he could whip any . man who associated with Rosenheim. I heard Enders say “Where is the d—d sen of a b—12” Soon after I saw Goldburg go out of the bourse, A short time after that Eaders and I wentdowa towards Goldburg’s. Enders is about five feet ten inches high, acd weighs about 180 pounds, and isa muscular man, Lasked Enders wheth er I might go with him when he started down towards Goldburg’s. I was a little fearful that he might have some trouble. In Chief Resumced.—Goldburg looks etouter . than Enders, but the latter is more museular, 1 did not see Enders have any weapons, and he had noue when I examined his person after he . was cut, Henry Brenton—I was present at the ball at Carter's, . went into the bar room and heard a fracas; went out to see what it was, and heard . Mnders say that Goldburg wanted to get into. the ball, but had no ticket; said that G. said he lad bought a ticket but hadn’tit with him. . Geldburg opened the door, aud Enders said, “1 wantthis door shut.’ Goldburg said that be had paid his money and could do as he pleased. They then went out. Euders was a little excited and went dowu the street towards Goldburg’s, and then came back. Afterwards he went up to Galdburg and said, “Louis, you have insulted me,” and then Goldburg ran the kuife into him. Goldburg was outside of the door wheu Eaders speke to him about being insulted. Kaders eame from down town, laid his hand on Groldburg and said, “Loxis. you have insulted me,” and then Goidburg, with bis left band, struck him with a knife. [ was about six or cight feet from them at the time. Geldburg stabbed Eaders the moment that E. laid bis hand oa bim, I did not see G. have a knife before the cutting. Cross-Examined.—I am in the employ of Eudere, I heard him say after Goldburg left, “Where is the d—d son of a b—bh?” and he also said he would whip G. if he saw bim. When we returaed to Carter’s there were four of us together—Brooks, Holland, Enders and myself. Enders said he would lick Goldburg for insulting him; that he did not allow any man to insult bim. The first thing Eoders did when we came up to Carter’s porch was to put his haud . on Goldburg and say, ‘You have iusulted me.” I grabbed hold of G.after E. said he was stabbed. This happened between 11 and 12 o’clock at night. After Enders was stabbed, they remained together but a few moments. I weot down to ‘*Celdburg’s house to see what was going on. I swear positively that I did not touch Goldburg until after he bad stabbed Eaders, There were cight or ten men around when Eaders slapped Goldburg on the shoulder, and they could all! see what was going on. I saw Enders, before he laid his hand on Goldburg, walk up te him, Jay his coat off, and say, “Now I am going te lick you—you son of a b--h.’? Enders had nothing in his hand then, After Enders was cut he picked upa stick, struck at Goldburg, and hit Holland’s hand, which was on G’s, head, The etick was about a foot and a half long, aud about an inch and a half round—a piece of ateve wood. Enders went into the house in about a minute or minute anda half after he was cut. Enders injured Holland’s hand with the stick. Holland, Brooks, Enders and I had been ruuning together that night. The crowd rushed together as soon as E.ders had taken off his coat. I do not think that Goldburg could . have got out of the crowd from the way they . got round him. In chief resumed.—I did rot see the knife until after the cut. At the time the stab was given no one had hold of Goldburg, but they grabbed him as soon as Enders said be was ent, Goldburg left immediately alter we let go our holds upon him. [ saw no weapon abont E ders. I grabbed hold of the haud of G. that had the kaife in it. Three or four men were standing with G. when E., the two others, and myself . went up. Goldburg said “On no,’’? when E. teld him that G. had insulted him. Thos. H. Brooks.—I fell in company with En. ders at the saloon opposite Goldburg’s house, . after the first fracas had occurred. He was! then with Holland and Brenton. We there drank and watked up to Carter’s to dance again. Just as we got there we saw five or six men in frent of the frout door of Carter’s house, and . Goldburg was with them. Enders approached him and lightly slapping bim ou the shoulder said, “Lewy, you have insulted me!” In a mo. ment after they had moved from their first! eters about two paces nearer the house, when nders exclaimed that he was cut, Then some . persons interfered—probably five or six—aud they were separated; after that, Goldburg at. tempted to pass down the street, between the crowd, aud Enders retraced his steps and came on the other side of the crowd; they met when . Enders was passing around the crewd, and E. picked up a stick some two feet long and struck . at Goldburg, but Holland received the blow. . Holland had hold of G’s. hair with one hand and his knife-hand with the ether. The blow knock. ed Holland's hand lone. and G. jerked back . 'toexplain seme d'fficulty, but 1did not hear / some interruption between him and Enders. . John Enders on yesterday morning at Humbug in the right side between the 7th and 8th ribs; . their testimony was not important. ' from Brooks, stepped round the crowd and p'ck, The second blow that Enders struck hit Holland , Enders picked up the stick I heard him say that . ' «take him away,’ when E. first struck at him. and made his eseape, I did not see the blow or the stab given. I think that Goldburg took one pace back when Enders placed his band upon him, No one had hold of either party at the time Enders said he wascut. I came up the street with Enders, and Goldburg was then standing probably three paces from any one else, near a table that was in the front yard. Cross-Examined.—I heard no threats made by Enders towards Goldburg. Isaw E's. coat . falling off just before he reached G, E's hand was moderately laid upon Goldburg. I did not see Enders strike G. before the stab was given. There was no excitement in the crowd when Enders firat approached Geldburg. I met Guld. burg very near Carter’s house, before I went to the saloon, about ten minutes before we came . back to Carter’s. G. hailed me and attempted . enough of it to say exactly what it was about. linferred from what he said that there was . Dr. R M. Hunt.—I was called to examine . 1 fonnd a wound made with a kmife about . City. The wound was three-fourths to one inch wide. it is upwards and backwards. It is a danger. ous wound, and I think the chances against his . recovery. The wound was enlarged by the . drawing out of the knife. Enders said that he thought he caught the knife. The evidence of A. J. Holland was similar to that of Brooks and Brenton. Several other witnesses were sworn for the prosecution, bat . EVIDENCE FOR THE DEFENSR. Robert Meacham.—I was at the ball but did not . see any portion of the difficulty. I saw Eaders . in the bar room quarreling with M-. Thomas. presently after Enders went into the ball room ard then came out and asked where Goldburg was, and said that he would have revenge out . of Lewy before morning. and he then went out . into the street. Enders first supposed that it was Thomas who had insulted him at the ball . reom door, Thomas was with Enders when he . went inte the street and down towards Goldburg’s store, James McGlinsey.—I was present at the stabve bing. and was there when Enders came up.— Goldburg was standing there with his hands in. bis pockets. Presently Enders and two others came up. and when he got within about five or six feet of G. be dropped a coat er talma, and said “G—d—n you Lewy” and mad a pass at him and grabbed hin by both coat collars, G. then caught him by his left collar and told Euders twice to keep away from him, and at the same time Goldburg put his hand into his bofrom, and in a moment or two after this Enders eried out that he was stabbed. Holland then came up and caught Goldburg. and Brooks caught Enders, who said *G—d—n it don’t hold me.” Brooks then let him loose. Holland marched G. down from E. and E. picked up a stick and struck at G. but I don’t know whether he hit him or not. Goldburg then got loose, ran up the hill, and Brenton after him. T then went back into the ball room, Ido not know whether Enders struck Goldburg or not when he first approached him outside the house ; but he grabbed him with both bands by the collar, Cross-Examined —I was not ever three feet from Goldburg when Enders made the pass at him just before be grabbed him, The next thiuz that I heard after Goldburg told Enders to keep away, was that the latter cried out that he was stabbed. J. S. Allen.—I was at the ball at Carter's on . last Saturday night, bat did not see any thing of the difficulty, except that there scemed to be . a free fight in the bar room, and Goldburg was on the outside looking through the window. Cross-Examined.—I saw Goldburg standing . outside of the bar room looking in at the window when the disturbance was going on ins d», I saw Enders inside the bar room at the same time. In Chief Resumed.—I think that Goldburg had paid to go into the hall, Rush Skidmore.—I was present at the difficulty, T was standing on the steps opposite the bar room doer with Goldburg and Edwin Henry . and James McGlinsey. We had been there . about ten minutes, when Enders came by me, threw his coat off and laid it on a beneh. and said “G-—d-—-n you Lewy, you have insulted ine.’ IT turned rouad at once and saw E iders take Goldburg by the collar with his left band and struck at him at the same time with his right hand. Goldburg made a step back then said “take him away from me.’ Holand then came reund and teok hold of G., and Brooks of E. and threw him off from the bouse. Holland pulled G. towards the house, Enders got loose . ed up a stick and eatas in frontof G. and struck athim. When Holland drew G. down by the . side of the house Isawa knife in G.’s hand. on the hand, and Goldburg turned reund and . wentupthe hill, Brenton started in pursuit of G. and halloord “harg him’? They ran round the upper side of the house, and a German by the name of Fred ran round the lower side of the honse, when Malone came out of the house. Enders then said “G—d—n you Brooks, . you hold me after a man bas stabbed me.” Malone asked Enders if he was cut. and he said yes, When Enders came up to Goldburg in the street . was about two feet from the latter. Euders stepped aside about four feet in order to get to where Goldburg was standing. When he was stabbed. I did not see G. strike at E. at all, but I heard G. say three or four times . Enders is about five feet eleven incbes high— pretty well built, and I think could handle Goldburg easily. Cross Examined.—The first I saw of the knife . was when Holland pulled Goldburg down by . the side of the honse. Goldburg came out of! the har room after I went ont. Enders strack Goldburg when he firat came up to him in front of the bar room at the platform. He struck him on the neck somewhere. The knife was . abont six inches long, with a white handle.
