The plagiarism would not appear in such a glaring light were it not for the fact that the autbor himeelf, in bis preface, boasts of the originality of*‘Lucile’’ as its distinguishing feature, In the dedi cation of the book, which is inscribed to his father, he observes: “I have endeavored to follow a path in which I could find no footprints before me, either to guide or to warn.” The Boglish critics will not deal very gently with that little aspirant. D. 1861, in said Court to obtain a decree of this Court for the foreclosure of a certain mortgage, bearing date the 12th day of October a. b. 1859, executed hy the said defendant to plaintiff, and for the sale of the premises therein, and in satd complaint particularly mentioned and described and the application of the moneys arising from such sale to the payment ot the amount due on four certain promissory notes set forth in said complaint, made and delivered to said plaintiff by the defendant bearing even date with said mortgage and thereby intended to be secured, to wit: The sum of $1,500, with interest thereon from the 12th day of October A. D, 1859, at the rate of two per cent, per month till paid ; and ifany deticiency shall remain afler applying all of said moneys properly so applicable thereto, then that Plaintiff may have execution therefor against the said defend. ant, also that said defendant and all and every per son claiming through or under defendant subsequently to the date of plaintiff's mortgage and the ecommencement of this action, may be barred and foreclosed of all right, claim, hen and equity of redemp tion in and to the said mortgaged premises, or any part thereof, and for such other and further relief, . or both, in the premises as may be just and equitable. And you are hereby notified that if you fail to answer said complaint as herein directed, plaintifl . will take judgment against you therefor by default, . together with all costs of suit, and counsel fees in the sum of $150 and also demand of the Court such oth er relief as is prayed for in plaintiff's said complaint.
