let and lease unto the said party of the second part
all the following described tract of land situate if
Bloomfield Township in Nevada County, State of calif@
nia and being all that tract of land now occupied by
said party of the second part as a reservoir and er
bracing all the land over-flowed by. said reservoir,
when it is full of water and also the land occupied &
_ the embankments which form the dams of said reservoir
said reservoir being situate on the North side of the
County Road leading from the village of Lake City to
the Town of North San Juan and being one half mile
. West of said Village of Lake City.
Said reservoir with its surrounding embankments
embracing above Six acres of land.

The consideration or rental of this lease or agre
. ment to be the premises as hereinbefore stated and als
. the annual sum of Ten Dollars in gold eoin to be paid
. on the 11th day of December of each year the term of
this lease to extend from the date hereof until such
. time as the land occupied by said reservoir may be
. needed in good faith for legitimate mining purposes
. by said parties of first part, their successors or
assigns.
The parties of the first part for themselves their
heirs or assigns however agree not to sink any shaft
or pits upon the ground herein leased nor in any mali
eious or uncalled for way to attempt to terminate this
