160 The Mining and Scientific Press. eae MINING AND SOIENTIFIO PRESS PATENT AGENCY. For the Pacific Coast. Orrice oF TRE Mining ayn Screntiric Press—No. 605 Clay street, corner of Sansome, San Francis¢o. Information for Inventors! Taventors on this coast having their applications for patents made out through our Agency can sign their pupers at onte, und thus secure their rights at least Uhree months sooner than by trusting the sume (o distant agencies, situated in New York or Washington, The Patent Law Amendment Act, of March éth, 1861, and Marcel 3d, 1863, nowin force, introduces scveral important changes In our Patent System. The gencral practice of the Patent Office, however, In regard to the cxamination and issue of Letters Patent tor new inventions, remains nearly the same as herctotore. The amendinentot 8d March, 1863, proyldes, in section 8, that every patent shall be dated asof a nay not later than slx montlis atter the tle at which It wns passed aud allowaud notice thercot seutto the applicant or his avent, Ani If the tlual fee tor such patent be net paid within tle suid six mouths, the patent shalibe witheld, and the invention therein described shall become Pie property as agalnst the applicant therefur! Preeided, That In all cases where patents have been allowed previous to tho passnge of thisact, the said six months shall be reckoned from the date of such passago. 7 The first qnestton, therefore, that presents itself te the inventor, who desires to procure a patent, is: “Gan lolitain a fatent?’? A positive auswer to this question ls only te he had yy prescuting n formal application fora patent tothe Goveru mient, embricing a petition, speel fication, model, duplicate drawings, and the payment of the prescribed otficral Te Asie trom these steps, all the inventor can do is, to subin his plans to persons experienced in the business of obtaining patents, and solicit their opinion and advice. 1f the parties Nonsulted are honorable mien, the Inventor may sutely con. nde his ideas to them, and they will intorm him whether or cot his invention ls probably patentable. Those who have ade Inventions and desire to consult with us respecting the same. are cordially invited to do so. We shall be happy to sec them in persen at our office, er to advise them Wy mail, or throuzh the Minine axp Scrgntiric Prass. In all cases they may expect trom us an honest opinion. For these consultations, oplniot and advice, we make no charge. A peu-and-Ink sketch, and description of the invention shonld be sent, together witha stamp for return ostnge. Write plain; do tot use pencil or pale Ink; be rief. : Remember that all business committed to cur care, and all wonsultations, are kept by us secret, and strictly coufidentlal. Caveats, A Caveat Is a confidenhal communication made to the Pataut Office, and is therefore filed within its seeret archives. The privliegc sceured unier a caveat is, that It entitles the carentor to recclve notice, for a perio Of one year, of anv application for a patent subsequently led, and which is adjudged to be novel, antl is likely to interfere with the Inyentlon described in the caveat, ani the cavcator is then required to cons lete his ication for a patent within three months trom the date of said notice. Caveat papers shouli be very carclully prepared. Our tee for the service yarles from $10 to $20. The Govornment fee unser the new law is reduecd to ten dollars; and this sum does not apply, as heretofore, as part ot the tee on presenting an application for a patent. . lnventors will ofttlmes find it very Importint to take advantage of the caveat system—the expense under the law being camparatively smal!. To enable us to prepare caveat Raper, we only require asketch and description of the Invention; no medel being necessary. Expense of Applying for a Patent, Rejoctions, eto. Under the new law, the Government fee, on fillng an application for a patent, is fifieen dollars ; and if tho patent is alowed, twenty dollars additional is required. 1f rejected, the first fee of fifteen dollars is all that is demanded. English, French, Austrian, Prusslan Spanish, and inventors of every nationallty, nay now obtain patents n the United ‘States upon the same terms as our own citizens. Tho only discrimination made is against subjects of gevernment that discriminate against the inhabitauts of the United States. To the foregoing official fecs inust he adder] the Attorney's fees for preparing the various documents and drawings. Our charge for preparing a ense, presenting itto the Gov ernment, and.attending to all business connected with it, until a dcclsion is given, Isfrom $20 to$i0. 1f tho patent is geantted no further agency expenses ensues. 1f the apyileation is rejected we a causcthorough investigation to be mado luto the reasons presented to the Commissioner tor refusing the patent. 1n making this examination, we have excess to all the drawings, models, books and specifications cited In reference, and we report the result as early as pos: aible to our elient. 3 If the rejection proves to be an unjust Ane wach soinetimes happens—it can generally be reversed, and the patet obtained by contesting thecasc. For this prosecntion we eharge a (ce proportionate to the extra laborinvolved, payable only on the issue of the patent; but our demand will be reasouabie and sutisfactory to our clleuts, and will be arrauzed beforehand by special agreement. The system adopted by us works well, slves gencral satlsfaetlon and presents to ali applicants, rich or poor, au equal Sr er unl of having their patent cases prepared, conducted and prosecuted in the best manner, by experienced at. torney's, npon the most moderate terms. Inventors who lave rejected cases, prepared either by themselves, or for them by other agents, and desire to.ascertain their prospects of success by further efforts, are invited to avail themselves of our unequalled facilitics in scenring favorable results. We have becu suecesstul in securing Letters Patent tn many eases of such a mutter. Our terins for such cases are very modcrate. Models, Remittances, eto. ‘ The law reqnires that the Inventor shall, In all cases, farnish amodel, which must not exceed twelve Inches in any of Its dimentions ; it should _be neatly male, of hard wood or metal, or both, varnished or painted ; the name of the nventor should be engraved or painted on it conspicuously. hen the inventlon consists of un improvement on some Known machine, a full working model of the whole will not be neeessary. it should be sutticiently perfect, however, to show with elearness, the nature and operation of the invention. As anon as the model Is ready, It should be earefully boxcd and shipped by express or otherwise, to our adilress, nainely: Dews: Co., Mining and Sclentitie Press, Nu. 505 clay Street, corner of Sansome, San Franeiseo, Cal. Prepay expenses and send express receipt to us by inail. Slmultanconsly with tle model, the inventor should send ua the first installment of the Gavernment tee, fitteen dollars. The money may be torwarded cither by express with the model, or by mail The satest way to remit is by drntt on San Francisco, payable to our order. Always send a Ictlter w ththe model, and also the remlttauee stating the nnme and addross of the sender, A full description should also be sent with the model, embodying all the ideas of the iuventor respecting the improvemen On the reeeipt of the model and Government fec, the ease iy dilly registered upon our books. and the appilenatlon ~ proceeded with asiasz as possible. When the docuincnts ure ready we send thein to the inventor by mall, for hly ox. amination, signature aud aftidaylt, with a letter of Instrnc» tion, etc. Ourfee for prevaring the ease Is then due and will be called for. The case will then be presented to the Patent Of2ce, and as soon as the patent, ls ordered to be isgued the Oovernment foc, namely, twenty dollars. Inventors who dv business with us will be notlficd of the state of thelr application in the Patent Office, when It ls posglble-for ustodoso. We do not require the personai attend: auce of the Inventor, unless It Is one of great compllention; tbe busincss can be well done by correspondence. When the Invention consists of 1 new article of manufacture, or a ueW compositlon, samples of the separate Ingrod!ents, sufficient tomake the ee ais and also of the mannfavtured article Itself must be furnished. The average time required to procure a patent, when the case Is conducted at our agency, is three months. We frequently get them throngh in less time; but In other cases, nuwing to delay on the part of officials, the period ls sometimes extended to four or five months, and even more. We ake speclal point to forward our cases as rapldly as possible. Patent Office Fees, and How Payable. Nearly all tho fees payable to tho Patent Office are pesliyely required by law to bo pald in advance. For the sake of unlforaiity and convenlence, the remaining feca will be raguired to bo pad in the same manner; that is to say, be. fore the labor is performed for which they are to ba recelyod in payment, = z The following is the Government tariff of fees established law: On every application for a design, for 3 y'rs and 6 nos.. $10 On every application for a design, for seven years. 15 Ou every uppheation tor a desizn, lor fourteen yea: 30 On every application for a patent, for seventeen yea 15 Onevery Gaveat..
