16 The Mining wd Scientific Press, MINING AND SOIENTIFIO PRESS PATENT AGENCY. Eor the Pacific Coast. Orrick oF THE Mining AND ScrENTIFIC Press—No. 505 Clay street, corner of Sansome, San Franctsso. Information for Inventors! Enventors on this coast having their applications for patents made out through our Agency can sign their papers at once, and thus secure their rights at least three months sooner than by trusting the same to distant agencies, situated in Naw York or Washington. The Patent Law Amendment Act, of March 4th, 1861, and March 34, 1863, now in force, introduces several lmportaut changes in our Patent System. The gencral practice ot the Patent Office, however, in regard to the examination and issue of Letters Patent {for new inventions, remains nearly the same as heretoforo. The amendinent of $d March, 1863, provides, In section 3, that every patent shallbe dated as ot a day not later than glx mouths after the time at which It was passed and allowed, and notlee thereof sent to the snp lesa or lis agent, And If tbe final fee tor such patent be not paid within the gaid slx montits, the patent shallbe witheld, and the invention theroin described shall become public property as against the applicant therefor: Provided, That in all cases where patents have been allowed prevlous to the passage of this act, the said six months shall be reckoned from the date of such passage. ‘Tbe first question, therofore, that presents itself to the Inventor, who desires to procure eae : "Gan Tobtain a patent ?' A positive answer to this question is only to be had y presenting a formal applicatiog for a patent to the Governnientembraciug a petition, specification. niodel, duplicate drawiugs, and the payment ot the prescribed official fecs. Aside from these steps, all the inventor can do is, to submit hig plans to persons experienced in the business of obtainlng patents, and soliclt their opinion and advice. If the parties tionsulted are honorable wen, the inventor may safely connde his ideas te tkein, aud they will inform him whether or cot his Invention ls probably patentable. Those who have made inventions mid desire to consult with us respecting the same, are cordially invited to do so. We shall be happy to see them iu gee fit our office, or to advise them by mail, or through the Mininc anp ScrenTiric Press. In alleases they may expect from us an houest ini For these opinion and adviee, we make nocharge. A pen-and-luk sketch, and descrlption of the invention should be sent, together with a stamp for return ee Write plain ; do uot use pencil or p: rier, Remember that all buslness committed to our care, and all iter w_thjthe model, and also the remittance stating the name and address of the sender. i ‘A full description should also be sent with the model, embodying all the ideas ot the inventor respocting the linprovement. On the recelpt of the model and Oovernment fee, the ease ls duly registered upon our books, and the application proceeded with asiast as possible. When the documents are ready we sead them to the Inventor by mail, for his examlnation, sighnture and affidavit, with a letter of Instruction, ete. Our tee for preparing the ease Is then due and will be called for. The case will then be presented to the Patent Ose, and as soon asthe patent is ordered to be Issued the Government fee, namely, twenty dollars. Inventors wlio do business with us will be notltled of the state of their application iu the Patent Olfice, when it is pos. sihle for nstodaso. We donot require the personal attendance of the inventor, unless It ls oue of great coniplication; the buslness can be well done by correspondcnec. When the hnivention consists of a new article of manufacture, or a new composition, samples of the separate ingredlents, sufficient to nike the experiment, and also of the manufactured article ttself must be furnished. The average time required (o procure a patent, when the case is conducted at our agency, Is three months, We frequently get them through in less tlme ; but In other cases, owing to delay on the part of officials, the period Is sometimes extended to four or five months, andevou more. We make a special poiut to forward our cases as rapidly aa possible. Return of Models. Under the new law, If the applicant’scase has been reject ed he ls entitled to withdraw hls model from the Patent Of tice. ice. This law applies to all past rejected cases, and If parties wish to obtain their models through us, they can do s0 ata small expeuse. Application for Patents, Designs, Trade-Marks, Labels, eto. Under the new law patents may be taken out for any new forni of any article, also tor tools, patterns, castings, machine-frames, stove-plates, borders, tringes, a1] now deslgns tor printing, weaving or stuniping upon silks, calleoes, carnets, oil-cloth, prints, paper-hangings, and other articles, riide-inarks, labels, envelopes, boxcs and bottles for goods, may also be patented ; likewise all works of art, Including prints, paintings, busts, statues, bas-rellet, or compositions in alto, or basso rellevo, now. dies, impressions, ornaments to be placed upon any article of manutacture, architecturai work, ete. Our facilities for the prompt Eeneretlon and securing of patents are ol' the most thorough character aud our charges are very moderate. Patent Office Fees, and How Payable. Nearly all tho fees payable to the Patent Ottice are positively required by law to bo paldin advance. For the sake of unlformlty and couvenlence, the SONS tees will be required to be puid in the same manner; thatIs to say, before the labor is performed tor which they are to be recelved In payment. ane tollowing is the Government tariff of fees established LW eousultations, are kept uy us sceret, and strictty Preliminary Exeminetions. Insome cases limay be advisable asa measure ot prudence to order a preliminary examination. This conalsts of 4 special search made atthe U.S. Patent Offies, Washingten, through the medium of our associate In that elty, to ascertaln whether among all the patents and inodci/s there stored, aly luvention can be found which ls similar in character to that of the applcant On the compjetion of this special search we senda written report to the party concerned, with suitable advice. Our charge tor this service, ineiudme the report, isten dollars, This search, though it iuvolves the expense just named, wlll usually prove satiss actory. If tho same devico has been before patented, the time and expense of constructing models, pacramn « docu. ments, ete., willin most eases besaved ; if the Invention habeen in part patented, the applicant will be enable to modfy hls claims and expectations accordingly. Many other obvious advantages attending the Prelimiuary Examluation ; although the strictest search does not always enablo the DU ueaDe to know positively whether a patent ean be had. pplleations for patents are often reo because the Examining officer fluds a description of the alleged luvention In some toreign publication ; or some other person has boen previously rejected on an analagous device; or some other Invention for a siinilar purpose, but partially resembles the applicant's in Its construction ; or the Govern. le Ink; be . Infringements. The manufacture, sale, or use of a patented article, with. out consent of the owner of the patent, is an Infringement, and subjects the infringer, by Injune tion from the Court, to an arrost of or prohibition from the employmont of this Tiachinery, shop, works, factory aud men In production of the artleie. Persons desiring the Preilmmary examination sre reqnestod to rentit the fee ($10), and furnish us with a sketch aud description of the inventlon. Caveats. A Caveat is a confidential commnnication made to the Patent Office, and is therefore filed within lts secret archlves. The privilege secured under a caveat is, that lt entitles the caveator to recclve notice, ler a perlod of one year, of an: qoplicaflom tor a patent subsequently filed, and whieh is adjudged to bo novel, and ls likely to Interfero with the inn the caveat, and the caveator is then required te <emplete his application tor a patent within threo m from the date ot sald uotice. Caveat papers should be very See RE ep Our fee for the sorvivo varies from $10 to $20. The Oovernment fee under tbe new law ls reduced to ten doliars; and this sum does not npply, as heretofore, as part of the fee on presenting an application for 4 patent. Inventors wlll ofttimes find lt very important to take ad. val eof tho enyeat system—the oxpense under the law being comparatlvoly small. ‘Yo enable us to prepare caveat paper, we only require a sketct: aud description of theinventlon; no model belug necessary. Expense of Applying for a Patent, Rejeotions, ete. Under tte new law, the Oovernmont fee, on filing an ap pheatlon for 2 patent, is fifteen dollars ; and If tie patent is allowed, twenty doilars additlonal is required. If rejected, the first fee of fifteen dollnrs ls all thatis demanded. English, French, Austrian, Prusslan Spanish, and inventors of every natlonality, nny now obtain patents in the Unlted States upon the same tcrins as our own citlzens, Tho only diseriminatlon made is against subjectsof government that diserlminate against the inhabitants of the United States. To the foregoing officlal fees inust be added the Attorney's fees for preparing the various documents and drawings. Our charge for preparing a case, presenting itto the Gov ernment, and attending to ail business connected with It, unttl a decision js given, isfrom $2010$40, It the patent is granted no turthor agency expenses ensues.s If the appllcation Is rejected we cause a thorough investigation to be made into the reasons to the © Iss] for refusing tho patent. In making tbls examlnatlon, we have excess to all the drawings, mouels, books and specifications cited in reference, and we report the result as early as pos4lblo to our client. if the rejeetlon proves to he an unjust one—which somctimes happens—it can generally be reversed, and the patent obtained by contesting the case. For this proseeution we eharge a fee proportionate to the extra labor involved, paynhle only ou the issuo ofthe patent; but our demand will he reasonable and satlsfaetory to our clients, and will be arranged heforeliand by special agreement. The system adopted by us works well, po general satlsfactlon and presents to all applicants, rich or poor, an equal oriprionity of having their pateut cases prepared, conducted and proseeuted In the hest manner, by experienced attoruey’s, upon the most moderate terms. Inventors who have rejected cases, prepared cither by themselves, or for them hy other agents, and deslre to ascertain their prospects of success by further efforts, are invited to avail theraSelves ot our nnequailed facilities In pecuring tayoraug rosulta Wo havo heen successful In securing Letters Patent in many cases of such a mattor.
