Said oath shall, before the time expires for the
doing of such work, be filed for record in the office
of the District Recorder.
Sec. 39. In case of the failure of a claimant to
do, within the time specified, anything on, or with
reference to» mining claim, which hy this Act is
required to be done within a specified time, said
thing may be done thereafter; and if such claim
has not been re-located after the expiration of said
time, and before said thing has been done, it shall
have the same force and effect as if done within
said time.
Sec. 40. The claimants of any mining elaim
who fail to comply with any of the provisions of
this Act, shall forfeit all right thereto, and shall be
deemed to have intentionally abandoned the same,
and thereafter such claim shall be snbject to re-loAll instruments filed in the office of
the District Recorder, and all records made in said
office, in pursuance of this Act, and all copies of
such instruments and records, duly certified by the
Distriet Recorder to’ he tull, true-and correct copies or transcripts thereof, shall he received as evidence ‘in all courts, and in all actions and proeeedings.
Sec. 42. Any person who shall willfully change,
deface or obliterate any instrument filed in the oiffice
of a District Recorder, or any reeord made in the
books of such office, or insert in such instrument or
record any new mattcr, or who shull-steal, or willfully mutilate or destroy any instrument filed in
the office of a District Recorder, or any part thereof, shall be guilty of 2 misdemeanor, and on conviction, shall be punished by fine, not execeding
fiye thousand dollars, or imprisonment in the
county jail for 4 period not exceeding one yenr, or
by both such fine and imprisonment; and shall be
liable, to any person injured thereby, for double
the amount in damages.
Sec. 43. The fecs of the District Recorder
shall be as follows: For filing any paper. twentyfive cents. For each one hundred feet of mining
ground measured, twenty cents. For measuring
the assessment workon the mining claim of any
eompany, giving a certificate in regard thercto, and
recording and indexing the same, two dollars.
For each certificate, twenty-five cents. Jor the
recording and indexing of nny instrument containing less than two folios, of one hnndred words
each, one dollar; and for cach additional folio,
twenty-five cents. For caeh certified copy of any
instrument or record eontaining less than two
folios, one dollar, and for cach additional folio,
twenty-five ecnts, including the eertifieate.
Sec. 44. All moneys paid to the District Reeorder, as assessment dues, shall be paid by him to
the County Treasurer on the third Saturday of August, November, February, and May, of each yeur.
The County Treasurer shall give a reeeipt for said
moneys, which shall be filed and recorded in the
office of the District Recorder. The County
Treasurer shall pay said moneys to the State
Treasurer at the sanie time and in the same manner that he is required to pay taxes to the State
Treasurer; and said moneys sball be set apart as
a mining sebool fund.
Sec. 45 The extraction of gold, or other metals, from alluvial or diluvial deposits, generally
exlled placer mining, shall be subject to such regulations as the miners in the several mining distriets shall adopt.
Sec. 46. In the conveyance of any interest in
any mining elaim, the description shall be deemed
sufficient if it embraces the number of feet conveyed, the namo of the claim, and the name of the
eompany hy whieh it is designated, and the district
and county in which the claim is situated.
Sec. 47. The provisions of this Act shall be
applicable to all the counties of this State, exeopt
the eounty of Storey, in which connty none of the
provisions of this Act shull be deemed to apply
or have foree or effect.
