Plivrity of possvesion, riglits to the use of water for tniolng, agricultural, matufuctuiiug or other purposes, buve
vested aud wccrucd, and the same are recoguized and ae
knowledged by the local custuins, liws aud the decisions
of Courts, the possessors and owners of such vested
rights shall he maintained and protected in the same ;
and the right of way for the construction of ditches and
canals for the purposes aforesnid js hereby acknowledged
andconfirmed: Provided, however, Tbat whenover, after the passage of this act, any person or persons shall, iu
the construction of any ditch or canal, injure or damage
the poxsesston of any settler ou the public domajn, the
pirty committiug sneh injury or damage shall he liablo to
the party injured for such injury or damage.
Sec. 10. And bo it further enac:el, That wherever, prior
to the passage of this act, ujon tho lands heretofore deslgnated as miueral lands, whieh have been cxctuded from
survey and gale, there live been bomesteads made by
citizens of tho Uuited Statos, or persons who bave declared
their inteution to becoine citizens, which homesteuds have
been made, improved aud used for agricultural purposes,
and upon which there have heen no valuable mines of gold,
eltver, cinuabar or copper discovered, and which aro properly agricultural lands, the said settlers or owners of such
hommestea Is shall bave a right of pre-emption thereto, and
Bhajl be entitled to purchase the same at the pricoof $1.25
per acre, aud in quantity not to cxeecd one buudred and
aixty acres; or said parties may avail themselves of the
provisions +f tho act of Congress, approved May 20,1862,
entitled * An Act to srcure homesteads to actual settlers
on the public domain,’’ and acts ameudatory tbereof,

Several of our most substantial and judiciously managed mining corporations have
passed resolutions, since the approval of the
new assessinent law, requiring all notice of
assessments and sales to be published in the
Mixixe axp Scimntiric Press, the only thorough (daily or weekly) mining journal on this
coust. Our efforts to concentrate ail mining
advertisements in one paper, for the economical
convenience of shareholders and assessment
payers, are meeting with decided success.
‘Those who believe in supporting tbe mining
cause, should bear our paper in mind, and
bring up this subject ut the next trustee or
shareholders’ meeting.
