(excepting having made an assignment of the ono machino now helonging to the Central Pacific Railroad
Qompany). Having resolved not to sell any rights
unless upon a basis of actual work performed by a
machine built by mysolf for the purpose of foirly es.
tablishing the worth of the invention, I therefore offer
to sell machines or rights on the following plan, which
is warranting the capacity of the machine by actual
work:
I will enter into an agreoment with ony responsible
party to build and sell a machino, scows and tender,
all complete, and right of afl my improvements in
dredging machines throughout the Pacific Coast for
$2u,000, warrantlng the machine to dredge six cubic
yards per minute (to fills scow st that rate). $20,000
will hut little more than pay the cost of huilding ‘tho
muchine, scows, etc., ali complete; therefore I am pro.
posing to ask nothing formy patente unless my machine
dredges more than six cubic yards per minute. But
it ehall be further agreed that in case (at a fair trlal to
be mado within n stated time) the machine shall fill
ascow at the rate of more than. six cuble yards per
minute, then $10,000 shali he added to the price ahove
stnted for each an‘l every such additional cuhic yard
thus dredged per minute, and for additional fractions
of a cubic yard thus drodged in the same ratio the
$10,000 ia to he added to aaid price above atated.
I will sell any other Territorial or Stato rights (either
United States or Foreign) upon the same plan and at a
lowcr price proportionately than the rights for the
Pacifio Coast.
I will sella single machlne with scows and all complete, and right to uso the same in a limited territory,
for $230,000 on tho eame plan as ahove stated, but will
add only $2,000 to euch additional yard over the six
cuhic yards per minute. Each machine is not to employ more than two 10x20 inch enginee.
