Dultov. She testified that she was in Mr
Dalton’s store, waen her father was having a
difficulty with an old man there, that these
two latter clinched, when Mr. Dalton came
up and tried te separate thein, and struck her
father with his fist, knocking his hat off, uit
her father then struck Dalton, who fell fer
sume boxes, when the, latter. got yy und
picked up a poker with which phy, striek
her father over the head, holding the poker
with beth hauds, and felled him te the fleer
Dr. Cleveland testified that Powers died
Mr’. Dalion, biuther of detetidant. testrfied
that un vld man wae sitting by the stove when
Powers came in and asked him where he was
from; that the old man answered him shurply,
