{HERI E'S SALE, — Whereas, on the
kD 6th day of April. A. b.1863,.a:final judg. .
ment and decree was rendered in the District
Court of the 14th Judicial District. of the State
of California. In and for the county of Nevada,
against H. McCharles and R. A. MeCharles, and
in favor of 8. M.Gilham,for the sum of Six Hundred, seventy and 93-100 dollars, principal -debt,
with interest on the prinerpal at the rate of three
per cent per month from the rendition of judgment until paid, together with all costs of suit.
And whereas, on the said 6th of April, 1863, it
__ was ordered and decreed by the said court, that
the mortgage set forth in. plaintiff ’s complaint
be foreclosed, andthe property therein. deseribed, to-wit: All that certain parce! of land or
oasessory claim now oceupied by these granors (i. e. the above named defendants MeCharles
and wife) aad duly recorded as such in the name
of John C. Collins in book. 1, page 140, records
of pre-emption claims for Nevada county, containing 80 acres, be the same more or less. The
said parcel of land situated upon Randolph Fiat
township of Rough ngieryy f sald county and
State, about one mile east fiom the village of
Rough & Really, and heretofore commonly
known aé MeCharles Ranch whereon is now
erected 4 certain ‘two-storied frame. House
known as MeOharles Hotel, with other improvements ; also, allthe right, title, interest
and claim of the said parties of the first part,
(i. e the above named defendants) in, to and upon all that certain Toll Road of dug way situated in’said township. county and State, commencing at the west end or foot of Penn Valley*
Hill, on the north side of Squirrel Creek, running to the village of Rough and Ready heretofore commonly known as MeCharles ‘Toll Road
together with all and singular the tenements.
