To the Honorable Superior Court of the
County of Nevada, State of California:
Now comes the Prosperity Uil Company,
and r tfully shows to the Court:
That it is a per a ion organized and
existing under and by virtue of the laws of
the State of California, and having its principal-place of business at Nevada City, in the
County of Nevada, in said State.
That its articles of incorperation were originally filed at the time o: the formation of
said corporation, in the office of the Count
Clerk of Nevada County, to-wit: on the i9%th
day of November, 190, a certified copy
thereof transmitted to the office of the
Secretary of State of California, tiled therein, and a certificate of incorporation duly
issued by the Secretary of State under the
seal of the State of California, certifying
that said corpo: ation had complied with ail
the requisites of the law, and was an existing corporation.
That thereafter, and within the time required by law, said corporation duly organized, elected its officers and ever since has
been and still is a corporation organized,
formed and doing business under the name
of thé Prosperity Oil Company, its eorporate name.
That the number of Directors of said cornamed in the articles of incorporation as
Directors, and ever since have been and still
are Directors of saidcorporation, the Proserity Oil Company, viz: R. C. Walrath, A.
B*Lord, A. #. Lord. 0. L. Muller, C. W. Chapman, J. 8S. MeBride and L S. Calkins.
That said corporation was duly formed on,

same in the County of Kern, state of California. That by reason of the identity of
name, confusion is ca trouble occurs in selling stock, and in various wa)s
the two eorporations are brought into conict by reason of the identity of name.
That the Prosperity Oil Company of San
Jose, California, claims that. it is the) first
appropriator of the name, and demands
that this corporation shall change its name,
that there may be no longer a conflict be
business matters by reason of the identity
of name.
Wherefore, your petitioners pray that
after due notice given, this Honorable Court
will fix atime andpiace for the hearing of
this petition. That.upon proof of the publication of this petition, for the time and in
the manner required by law, and after hearing the evidence in support of this petition,
this court will make its order changing the
name of petitioner from the Pro.perity Oil
Company to the McKittrick Prosperity Petroleum Company, and that such other and
further proceedings may be had in relation
thereto as to the court may seem proper,

The B rd of Supervises of the County
of Nevada do ordain as follows:
Szctton i. The right and privilege is
hereby ted to John Martin, his heirs
and acel , to construct’. and operate a
stréet raliroad along and upon the county
road between the corporate limits of the
City of Nevada and the City of Grass Valley,
by way of Town Talk, insaid Nevada County.
Said railroad to be operated by either elec‘tric power, steam power, power derived
from compressed air, liquid air, undergronnd cable, horses or mules. Said railroad’ to tonsist of either single or double
track witkinecessary turn-outs and switches,
SROTION The ties and rails of said railroad shall be so placed as to afford no unnecessary obstruction to travel on said
county road, and the same shall be so located
on such route as shall be directed by, and to
the satisfaction of the Supervisors of the
. First and agin Supervisorial Districts of
said Nevada County. If said road shall be
operated oy
be operated by overhead trolly system, and
the poles carrying the power current shall
in a safe, substantial and workmanmanner, and ahall be sufficiently removed from thetraveled part Of said road so
as not to interfere with the travel thereon,
and' wires shall be strung on said poles in a
manner to prevent their coming to the
ground.
SEcTION 8 Thé said grantee and his assigns, shall paye or macademize the traveled
t of said county road, between the rails,
tween the tracks, and for two feet on each
side therof, with the same material used ed
the county upon the highways over which
said runs respectively, and keep the
same constantly in repair. flush with the
highway and provided with suitable crossings; and shall make the road bed ecnform
at all times to the established grade of the
said highways; all repairs and grades to be
made under the instructions, and tothe satisfaction of said Supervisors of the First and
Second Supervisorial Districts, Incase the
said grantee, or his assigns fail to comply
with the instructions given by said officers
for ten days after service thereof upon the
agent of said grantee, resident in said Ne. vada County, the said Supervisors, or their
employes, may enter upon the road of said
grantee and dothe work as ordered ied the
said Supervisors; said Supervisors to keep
an itemized account of the cost of said work,
which raid grantee bv the acceptance of this
franchise hereby agrees to pay immediately
upon its presentation to said grantee’s local
mt stationed in said Nevada County.
ECTION 4. Cars shall be run over the road
constructed under this franchise during
every day, unless prevented by the elements
or unavoidable accidents.
PROVIDED, further, that cars shall be operated upon said lines at intervals of not
more than one hdéur between the hours of
7;30.a.m.and 9:30 ». m. each and every day,
unless prevented by the elements or unavoidable accidents. ‘
SkoTIoN 5. The taid grantee, and his assigns, shall construct all necessary flumes
and culverts forthe free passage of water
under the tracks of said railway, where the
Same naturally flows; and all curves, acqueducts turnouts and switches, shall be constructed under the plans and specifications
approved by the Supervisors of. the First
and Second Supervisor‘al Districts, aforesaid.
SECTION 6. TheCounty, of Nevada, in making the grant of this franchise, ex ressly re
serves the right to pave, macadamize, renew or sewer any of said shighways, or to
lay gas, water or other pipes therin, such
work to be done so as toinjure said railroad
as little as possible.
SECTION 7. Provided further.that the cars
upon said road shall not be allowed to stand
on the highway or highway intersections in
highways by yehigies,
SEoTIon8 That the rate of fare,one way,for
any distance along said road, or along said
road and any connecting line or lines leading to and into the City of Grass Valley, or
into the City of Nevada, in said county. and
opepating under this frauchsse shall not exaed fifteen cents fur o ne enger.
SgoTion 9. Work shall comn.enced by
said prises within the petiod of three
months from the final passage of this ordinance.
Sgction 10, This privilege shall continue
for the term ¢f one year and eleven and
one-half months from the date of the final
passage of this ordinance.This ordinan“e shall take effect and be in
force on and efter fifteen days from the date
of its passage.
