PE LOS eter OR as rn’ ity Daily Transcript. VOL. LXVI-=NO. 10258 NEVADA CITY, CALIFORNIA, WEDNESDAY EVENING, APRIL 18, 1894. . i 2. Established Sept. rs 1860, ey N.P. segue fash de tes secede natin THE DAILY TRANSCRIPT Justice Handicapped. Whenever it comes to the trial of a npterious Criminal like that.of Fredericks, justice finds herself dreadfully handicapped. Intelligence and knowledge constitute an absolute bar to service on the jury.. Ignorance is at a premium—the denser it is, the more acceptable it is to the defense. The jury, it is true, tries the facts; the court applies the law. But the ignorance of some jurors who try important criminal cases is so dense’that it cannot, half the. time, even with the guidance of the court’s instructions, separate the facts from thelaw, mixing the two up im the most confusing manner in the effort to analyze the testimony. If Fredericks escapes his just fate, justice would be defeated by the ign»rance which must necessarily occupy the jury box, for any man who reads a newspaper is disqualified from service. Only.two jurors have thus far been selected and neither—reads—current events, Published Every Evening, except Bunday. —— BROWN & CALKINS,Proprietors. Who the attaching parties are and the amount attached for, we do not know. This miue_has_only been running for a little while and the failure is, presumably, the result of bad menag ment, as the mine is known to be rich. Bad management is, and always has been, the bugbear of this county. Many good mines have been ruined by mismanagement and everyone-so ruined helps to yive the county blacker name and keep capital away. It should be usade a peual offense for a man who knowg absolutely nothing about mining to undertake the management of a piece of property.
