hereby granted to John Martin, his heirs
and assigns, to construct and operate 2

SECTION 2. The ties and rails of said railroad shall be.so p'aced as to afford no fs

the satisfacti: n of the Supervisors of the
First and Second Supervisorial Districts of

the poles carrying the power current shall
be setin a safe, substantial and workmanlike manner. and ahall be sufficiently removed from thetraveled part Of said road so

manner to prevent their*coming to the
ground.
SECTION 8. The said grantee and his assigns. shall pave cr macadefnize the traveled
part of said county road. between the rails,
between tre tracks, and for two feet on each
side therof, with the same material used by
the county upon the highways over which
said road runs respectively, and keep the
same constantly in repair. finsh with the
highway and provided with suitable crossings; and shall make the road bed ecnform
at all times to the established grade of the
said highways; all repairs and grades to be
made under the ins'ructivns, and tothe satisfaction of said Stpervisors of the First and
Second Supervisorial Districts,
said grantee, or hs as-igns fail to comp'y
with the instructions given by said officers
for ten da3s after service thereof upon the
agent of. sald grantee, resident in said Nevada County the said Supervisors, or their
employes, may enter upon the road of sad
grantee and dothe work as ordered by the
said Supervisors; said Supervisors to keep
an itemized account of the cost of said work,
which said grantee bv the acceptance of this
franchise hereby agrees to ray immediately
upon its. presentatiori to said grantee’s local
ent stationed in said Nevada County.
SECTION 4. Carsshall be run over the road
constructed under this franchise during
every day, unless prevented by the elements
or unavoidable accidents.
PROVIDED, further, that cars shall be operated upon said lines at intervals of not
more than one hour betweepv the hours of
7:31 a.m. and 9:30 ». m. each and every day,
unless prevented: by the elements or unavoidable accidents.
SEcTION 5. The, ‘aid grantee, and his assigus, shall construct all necessary flumes
and culverts forthe free pissage of water
under the tracks of said railwsy, where the
samme naturally flows; and all curves. acqueducts turnou's and switches. shall be constructed under the plans and, spe cificarions
apvroved by the Supervisors of the First

SECTION 6. TheCountv of Nevada, in makug the grant of this franchise, expressly re
serves the right to pave, macadamize, renew or sewer any of said highways, or to

SEcTION 7. Provided further.that the cars
upon said road shall not be allowed to stand
on the highway or highway intersecticns in
such a manner as to obstruct the use of said

into the City of Nevada, in said county. and
