The Story of a Picture,
Benjamin West’s picture of the
“Death of Nelson” ig closely connected
with an anecdote of the great sailor.
Just before he went to sea for the last
time he was present at a dinner, during whicb he sat between the artist
and Sir William Hamilton. Nelson was
expressing to Hamilton bis regret that
he had not, in his youth, acquired some
taste for art and some discrimination
in judging it. “But,” said he, turning
to West, “there is one picture whose
power I do feel. I never pass a shop
where your ‘Death of Wolfe’ is in the
window without being‘stopped by it.”
West made some gracious answer to
the compliment, and Nelson went on,
“Why bave you painted no more like
it?”
“Because, my lord,” West replied,
“there are no more subjects.”
“Ah,” said the sailor, “I didn’t think
of that.” :
“But, my lord,” continued West, “I
am afraid your intrepidity will yet
furnish me with another such scene,
and if it sbould I shall certainly avail
myself of it.”
“Will you?” said Nelson—“will you,
Mr. West? Then I hope I shall die in
the next battle!”
A few days later he .sailed, his
strangely expressed aspiration was realized, and the scene lives upon canvas.
Couldn't Do the Impossible.

“Oh. not at all,” replied the vender
cheerfully. “We don’t pretend to be
able to restore the hair lost in the procvss of evolution!”
An innocent bystander cracked a
faint smile, but otherwise all was still.

find one man lying on the ground with
two bullets in him and some people
carrying away a second with half a
dozen.
“Dogfights are bewtiful affairs,” said
the colonel as we walked away, “but
the safest way to see one in Kentucky
is to wait till it’s all over and the dead

‘"he.Hoard of Supervisors of the County
of Nevada do ordain as fotlows: 1
SEcTION 1. Ihe right and privilege is
hereby granted to John Martin, his heirs
and assigns to construct and o,erate 2
street railroad alorg and upun the coun'y
road between the corp: rate limits of the
City of Nevada and the City of Grass Valley,
by way of Town Talk, insaid Nevada County.
Said ‘railroad to be operated by either a
tric power, steam p wer, power. derive
from ‘ecmpressed air, liquid air, seder:
grornd cable, horses or mules. Said rairoad to consist o! either single or double
track with necessary turn-outs and switches.
_SEOTION 2. The ties and rails of said railroad shall be so p'aced as to afford no a
necessary obstruction to travel on sa <
county road, and the same shall be so locate
on such route as shall be sirected by, ond
the satisfacti:' n of the Supervisors of the
First and Second Supervisorial Di:tricts of
said Nevada County. If said road shall be
overated by electric power the same .

SECTION 8. The said grantee and his assigns. shall pave cr macademize the traveled
part of said county road. between the rails.
between tre tracks, and for two feet on each
side therof, with the same material used ad
the county uponthe highways over whic
said road runs respectively, and keep the
same constantly: in repair. fiush with the
highway and provided with suitable crossings; and shall ake the road bed ccnform
at alltimes to the established grade of the
said highways; all repairs and grades to be
made under the ins‘ructiuns, and tothe satisfaction of said Supervisors of the First and
Second Supervisorial Districts, Incase the
said grantee, or h s as-igns fail to comp'y
with the instrnetions given by said officers
for ten da3s after service thereof upon the
agent of said grantee, resident in said Nevada County the said Supervisors, or their
employes, may enter upon the road of sad
grantee and dothe work as ordered by the
said Supervisors; said Supervisors to keep
an itemized account of the cost of said work,
which said grantee bv the acceptance of this
franchise hereby agrees to ray immediately
upon its presentation to said grantees local
agent stationed in said Nevada County.
SECTION 4. Carsshall be run over the road
construcred under this franchise during
every day, unless prevented by the elements
or uuavoidable accidents.
PROVIDED, further, that cars shall be operated upon said lines at intervals of not
more than one hour between the hours cf
7:30 a.m. and 9:30 ». m. each and every day,
unless prevented by the elements or unavoidable. accidents,
SECTION 5. The raid grantee, and his assigns, shall construct all necessary flumes
and culverts forthe free pissage of water
under the tracks of said railw»y, where the
same natura!ly fl ws; and all curves. acqueducts turnou’s and switches. shall be constructed under the plans and sp«cifications
apvroved by the Supervisors of the First
and Second” Supervisorial Districts, aforesaid.
SECTION 6. TheCountv of Nevada, in makivgthe grant of this franchise, ex ressly re
serves the right to pave, macadamize, renew or sewer any of said highways, or to
ley Ras, water or other pipes therin, such
work to be done so as toinjure said railroad
as little as possible.
SECTION 7. Provided further that the cars
upon said road shall not be allowed to stand
on the highway or highway intersecti ns in
such a manner as to obstruct the use of said
bighways by, vehicles.
SEcCTION8 That the rate of fare,one way,for
any distance along said road, or along said
road and any connect ng line or lines leading to ard into the City of Grass Valley. or
into the City of Nevada, in said county. and
opepating under this frauchsse shall] not ex‘eed fifteen centsf r« ne passenger.
SECTION 9. Work shall be comnenced by
said grantee within the peiod of three
months from the final passage of tLis ordinance.
Sscrion 10, This privilege shall continue
for the term «f one year and eleven and
one-half mooths from the date of the final
passage of this ordinance.
This ordinan’e shall take effect and be in
force on and »fter fifteen days trom the date
of its passage.
