Amendments to and Omissions From
the Mineral Land Bill.
Examiner: -The miners. are much less
gone to the Senate than when it was introduced in.the House, It was prepared by the
Miners Aasociation of this State, and its
purpose was to remove difficulties towards
obtaining title to mineral fands. As the law
stands, and in the bill as prepared, it was
proposed to treat a mining region as priuva
facie mineral land. But in its amended form
it presents several objectionable features,
which it will be the object of the mining
association to eliminate. Speaking of the
House bill, Senator Tirey L. Ford, Chairman of-the Association’s Committee on Legislation,-explained the objections.
“The bill you refer to passed the House
on the 8th of this month, and on the 10th
was read twice in the Senate and referred to
the Committee on Pablic Lands. The bill
is in some respects modeled upon the bill
tion and introduced in Congress by Mr.
duced by Mr. Newlands for the reason that
he is a member. of the House Committee on
Mines and Mining, while California has one
representative upon that committee. The . ened 1 foot, and about 1200 feet of ditch to
bill you refer to is a separate aud distinet bill . je widened from about 6 feet on top ‘sind 4
feet on bottom to 74 ft. on top and 44 ft,

from the one prepared by the Miners Association, and was, I think, introduced by Mr.
Caminetti. ;
“The Caminetti bill provides‘ that in contests between mineral and agricultural claim . gates, etc.
All lumber to be furnished by said comMrs: A: % Hancock
ante the testimony may be taken under such
regulations and notice as the Commissioner
of the General Land Office may prescribe.
The Newlands bill, which follows the present law in that respect, provides that in al}
such contests the party contesting must serve
personal notice of contest upon the opporing . of the Co, before the lat day of September, </ STE : i

party, or, if that cannot be done, then netice
of the contest must be published for thirty
days in the newspaper published nearest the
land in controversy. The miners would feel reject any and all bids.
safer under the law as it stands at present
than under a law that would leave the matter subject to the varying notions of the
Commiasioners of the General Land Office.
. “Another change from the Newlands bill
is in the substitution of the word ‘corroborative’ for ‘presumptive’ concerning the
effect of the discovery of mineral in adjacent
land. In the Newlands bill it is provided
that when it is shown that :nineral has been
* Giscovered or developed in the adjoining
land:it-shall.then.be presumed that the land
in question is also rhineral in character; but
‘in the Caminetti bill proof of such adjacent
fiineral is mereby corroborative evidence of
the fact that the land in question contains
mineral. !

“In other respects the Caminetti bill

copy pretty closely the Newlands bill and
contains some wise and valuable provisions.

I notice one omission from the Cuminetti
bill, however, that further distinguishes it
from the Newlands bill. In the Newlands VIOLINS
bill it is provided that when the proofs BANJOS
therein required are made, the. land in queeMANDOLINS

mineral in character. The Caminett bill aren
omits this provision. The miners felt that AGOORD AONE
