A little more than tw6 weeks ago when the matter of a recount of the votes polled for the office of Governor in San Fraucisco was being talked of, the Examiner reported i Mr. Budd as saying he did not fear a re“count; in fact, he desired to have the frauds exposed if there had» been any committed. Since then the gentleman has been {quoted as saying that if a recount is had_ his plurality will certainly be increased. These ‘gtatementé indicated that he really was anxious to have an investigation to determine if there had been fraud practiced in making the returns of the votes polled. But the fellowing extract taken from a reported interview with Mr. Budd on Monday after the action had been taken initiating a contest, shows shat he was not sincere and that he evidently fears the result of an investigation: ‘This action shows that some of the Re‘publican commitiee wish to seat Mr. Estee I nave been elected. In that case Evans, Republican, has about 1200 plurality, as shown on the face of the returns, yet the charge of fraudulent work by the election boards in the city of Nash-wille_is. openly_made. an investigation of the evidence of fraud, that they are entitled to a recount of the ballots in certain, precincts to determine to their satisfaction if Evans has the plurality claimed. If the argument is good in Tennessee, why is it not good in California; and if so, why should Mr. Budd talk about being defrauded? pipes THE HARTLEY CASE. The Principal Points on Which a New Trial Is Asked. The case of Mrs. Hartley is still being agitated in Reno, and there is much speculation as to whether Judge Cheney will grant a new trial. There are several points upon which General Clark, who has recently _ come into. the case,‘asks anew trial, Itis claimed by him that the jury which convicted her was’ not a constitutional jury because net composed of impartial] and unbiased members. Several’ of the jurors, General Clark e'aims, were biased and had expressed their ideas on the street and admitted itin the court-room when ‘examined. He has filed bills of exception in the case of each, and in the case of some, affidavits showing that they had expressed unqualified opinions. In summing up, the attorney for the defendant classified his claiins as follows: That the instructions were§misleading bxcause they recited only a part of the facts relied on for the defense. _ They admitted the threat to procure false testimony. Also admitted all reference to dafendant’s fear and state of health. Also al] reference to the defense (of insanity. i) The Court.excluded the evidence that the deceased advanced with a up-lifted chair, It is related to the first and not the fatal shot. ; The Court charged that their evidence if true contributed no justification for the killing, That the Court erred in excluding the testimony that the defendant attempted to leave Reno.
