Each of these witnesses was subjected to a rigid cross-examination by District Attorney Power who displayed ‘marked ability and shrewdness in making them tell all they knew. In the afternoon Manion testified that Thomas was with him all but 15 minutes the evening of the alleged assault. Bert Clarke saw him in the Arcade saloon at 10:30 and Martin Hoskin an hour earlier. Frank Thomas, defendant’s brother, swore it would take 25 minutes to walk from the saloon to the place of assault. Reuben Thomas, hie father, testified that the shed his son was alleged to have locked the girl in was open on one side and that he had warned bis son against the girl.
John O'Neill, shorthand reporter, testified as to the preleminary hearing, and at 3:15 court took a recess for fifteen minutes. . This is one of the most hotly contested battles that has been seen in the criminal department of the Superior Court for years. District Attorney Power is making the fight for the peois, winning for him commendation on every hand. Against him there is arfayed an unusually able trio consisting of A. D. Mason, who has had long ‘years of successful practice in some of the principal cases tried in the county; George L. Jones of Grass Valley, a capable and clear-headed lawyer who was the Democratic candidate for District Attorney in the last election, and exCongressman Grove L. Johnson who easily ranks as one of the foremost criminal lawyers of the West. ES Telephones Now in Service. L’Illustration, remarking on thenumber of telephones in service in the United States, deplores the lack of readiness to employ these instruments in ‘Europe. In Berlin, where there are 30,000 in use, the average number of calls is not more than seven a day—two in the morning and three or four in the afternoon. Among the European countries Germany and Eugland hold the lead, with 140,000 and 116,000 instruments, respectively.
