Judge Ooughian was engaged this morning in listening to the evidence in the battery case, which resulted from the fights last Friday and Saturday nighte. The first witness called was Deputy Sheriff Thomas H. Waters. He testifled that lest Friday night about 12 o’clock, McOloskey and Morgan came up.to the court house, and Morgan asked if the jury had been taken into court and how they stood. He replied he did not know. McOluskey said that Haley had told them the jary wae going to be taken into court. MoOloskey called Haley a d— liar and struck at Haley, bat missed him and they clinched. Waters separated the fighters and told them he would lock them ap if they did not get out of the courthouse, Haley asked Waters to arrest MoOloskey and Morgan, but he did not do so and they left the court house. He then went up to the fighters and put his hand on their shoulders and said: “Now, here boys, stop.” Morris Gallagher belped. him separate them. McOloskey said if be were on top no ove would pull him off. Haley again renewed the fight and struck McOloskey wlien he was being held. The crowd said let bim go if he wants it. Morgan struck Haley in the face and jumped back. Haley was -knocked down on his back and was helpless. George and W. Oarter were coming down Broad street and saw the fight but did not know who were fighting. He went up to Maitland’s saloon and told McOloskey and together they went to-his o { and telephoned to Prisk. They afterward came downstairs and crossed the street tosee Dave and ask bim about the matter. Just as he stepped on the sidewalk Haley came up the street, and hit him in the face and knocked him up against the post. His right hand was in his overcoat pocket at the time he was struck. The blow stunned bim for a. moment. Haley then hit: McCloskey and they started to fight. He said be was angry and struck Haley with his fist while he was down. Joseph Martin was walking up the street and saw Haley strike Morgan a blow, and blood began to flow from his nose. He asked him what it wasdone for, and he did not know what he said, He could not swear whether it was the first blow struck or not. This afternoon the taking of testimony was resumed, W. F. Prisk being the first to take the witness etacd. Mr. Prick testified that Haley called him up by telephone and told him that he heard that Morgan and McCloskey was going to reuew the attack on him Saturday evening; that he told Haley}. to take any ingulte and not to have] any trouble unless it was forced on him; that if it was forced on him to protect himself as® best he could. Witnegs stated that he cal ed up D. E, Morgan by ’phone and told him that it was reported that MoOloskey and his (Morgan’s) brother would attack Haley again and that in justice to him, himself and Haley be had called him up and informed him, in order to evoid any trouble that might bappen. Witness stated he did not make any threats over the telephoné and what he said was not threats; that he did not say that Haley was heeled,. or anything to that effect. Witness also stated that McOloskey called him up by ’phone in the afternoon and asked if be or Haley had threatened him; that he replied that he nor Haley had made any threate and hat if he (McOloskey) had any difference with any of his employes, to come down and see him. Thomas Ingram, Charles Prisk and Henrf Argall, who beard Mr. Prisk telephoning to Mr. Morgan, made about the same statement of the affair. The Judge will pronounce sentence tomorrow morning at 10 o’clock. Or Fight Will Be Sitter.
