Judge Nilon denied the motion for a
new trial in the case of the people
against Alfred Johnston. His attorneys excepted to the ruling, and then
his honor sentenced the young man to
five years’ imprisonment in the State
prison at San Quentin. A stay of execation was asked for and denied, and
then Johnston was remanded to the

This afternoon his attorneys got ou
a certificate of probable cause, tending
to show that there might be grounds to
warrant the defense appealing to the
Supreme Court from the order refusing a new trial. Judge Nilon signed
this and admitted Johnston to bail in
the sum of $10000 pending the action of
the higher court. Bail was furnished.
The action in this case is not unusual. A similarcourse prevailed after
the conviction of Frank Wright of
North San Juan of. committing mayhem
in biting off Henry Fuller’s ear. It
was several months after his conviction
before the Supreme Court sustained
the.decision of the Superior Court and
‘ibe Ratentiaat had to go to prison.
Johnston’s case is the first and only
one that has been tried under the law
passed by the last Legislature, raisingthe ,age of consent to sixteen years.
The girl involved is named Bertha
Smith and is of an excellent family at
Grass Valley. She was less than sixin, case he did so he would not be comand might get a divorce as quickly as
the statutes permitted. He “stood pat”
on the proposition that he was not the
guilty man, saying that he would go to
prison before doing suchathing. In
this determination his relations, or at
least a portion of them, upheld him.
Now powerful influences are being
brought to bear té prevail on Governor
Budd to pardon him so that he will
not have to suffer the stigma of being
even for a day an inmate of the penitentiary. It is generally believed that
the efforts to secure his pardon will be
‘successful and that the matter will as
a consequence soon. drop ont of the
courts.

Senior, who are farmers living in Grass
Valley township below Allison Ranch,
took their guns Sunday and started out
hunting in the vicinity of Forest
Springs. They did not have the best
kind of luck, because there was not
much in the way of game to shoot at.
Along late in the day they got separated. Thompson was beating his way
through some heavy undergrowth and
had reached a snfiell clearing when
he discovered not thirty feet away a
monster wildcat crouching as though
ready to spring on him. His gun was
loaded with birdshot and it only took
him an instant to decide what to do.
Dropping the weapon he shinned up a
tree like a squirrel. The cat trotted
over to where the gun was, smelled of
it and stretched itself out on the
ground as if waiting for the owner to
come down and claim possession.
Thompson shouted himself hoarse, and
finally Colvin heard him. Approaching the scene Colvin emptied a charge
of buckshot into the wildcat and it
‘died without a kick. It weighed forty. eight pounds.

killed and another so severely injured
that she will die, as a result of a fire in
C. H. Raymond’s mansion this morning. The dead are Mrs. Underwood,
who was a guest of the Raymond family, and Harriet Fee, a servant. Mrs.
Raymond was fatally hurt. The women
jumped from a window. Two firemen
and a passerby were also injured. The
mansion was destroyed.
