Mining Convention Episode.
A Thin Explanation of the Way or
Delegates Were Thrown’ Down.
A few days ago the TRANSCRIPT pubSecretaryship of the Miners Association of California us obtained from
some of our citizens who. were there as
delegates, and in the article the sentiments of anger and disgust as expressed
by most of the delegates from this locality. were set forth. The Oroville

Ed Goldsmith, an old-time Nevada

Mail Contractors Not Paid.
It bas been several months since the
stage companies carrying United States
mails on the star routes in this part ‘of
the State have been paid off. Heretofore they -have received their drafts
regularly each month. It is supposed
that the rasb of business at the Postoffice Department incident upon the
establishing new offices in Cuba, Porto
Rico and the Philippines and the extraordinary demands upon the government for money in prosecuting the war
with Spain have caused the delay.'Thecontractors have no fear but they will
get their money. The inconvenience
from not getting it promptly is what
worries them.

be slow to see the purpose and inspiration of it:
“It is reported that the Nevada county
delegates to the Miners’ convention
went home very much dissatisfied with
the result of the election for Secretary
of the State Miners Association. Nevada county asked that this office be
given to one of her favorite sons, Mr.
R. H. Turner, son of one of the pioneers who have made Nevada ‘county’s
history while wresting riches from her
hills, a worthy young man, who, had he
been elected would have performed the
duties of the office most creditably.
There was another candidate for this
honor, however, Mr. E. H. Benjamin of
Alameda, and he was elected over Nevada’s candidate by a small majority,
due no doubt, to the fact that he enjoyed a /wider personal acquaintance
among the delegates than did his opponent.
“Speaking for the dissatisfaction, the
Nevada City Transcript says: ‘Within
the last three years this county las contributed over $3,000 to the coffers of the
association. This year we put up about
$900, aud Placer county, which came
next, contributed only $400. In other
words, this county has done more than
twice as much as any other county to
keep up the expenses of the organization. A feeling has sprung up in numerous quarters here since the last session that we are too guileless. The little old office of secretary, which was the
first thing we had asked for in return
for the part we were playing in the association, was brusquely refused us, and
we were laughed at for our pretensions
Really, isn’t it time that the people of
Nevada county awake to the fact that
they have played second fiddle in this
matter about long enough.’ .
“The Transcript is in error in stating
that the Nevada county delegation was
Jaughed at forits pretensions. Among
those who voted against her candidate
were some, and probably many, who
recognized the justice of Nevada’s
claim but who favored the other mau
because they considered he also bad
some'claims and because of personal
friendships for him. These delegates
did not believe that the 147 delegates
from Nevada couuty would refuse to
bow gracefully to the wil! of the majority in the matter, and the Mercury
does not believe it yét, notwithstanding the fact that the TRANscRIPT seews
to voice a defiant spirit. ;
“We do not believe that Nevada couny, which has been the main pillar of
‘he organization since its inception,
without asking for a single honor, is
going torisk the effectiveness of the
organization which has done and can
do so much for the principal industry
of that county, through any feelitig of
elections.
“We would rather believe that Nevada county will carry out the threat
made by Judge Walling upon the floor
of the convention when he said that
Nevada would come into the convention with delegates enough to tuke all
‘the offices; and for our part, the Mercury is willing she should, for she has
plenty of good men,
“Nevada county has contributed

treasury of the State organization the

She has paid this money to assist in
accomplishing the work for which the

expended. Nevada county knows that
it has, and, while her people cannot be
expected to feel otherwise than disappointed over the secretaryship, it is
safe to assume that they will not permit their allegiance to waver, whatever
the TRANSCRIPT may say.”

Wm. Bourne, the mining man, was sustained. Mr. Bell’s motion to dissolve
the injunction was granted.
The hearing of further argument in
the suit brought by Mary A. Bennallack against W.G. Richards, executor
of theestate of Philip Richards; deceased, was postponed till Wednesday.
Robert Hooper, charged with the
murder of Mark Oasey, was arraigned
and given till next Saturday to plead.
The will of Mary McCarthy was admitted to probate. George F. Murphy
was appointed executor without bonds.
Peter Purcell, George F. Murphy and
Jacob Weissbein were appointed appraisers.
The case of Freeman vs. Getchell was
continued till next/ Monday when it
will be set for trial.

Joseph Tibbett was arrested today for
disturbing the peace of Joseph Enos
yesterday afternoon. He pleaded not
guilty and Justice Green bound him
over in the sum of $50 to appear tomorrow for trial.
John Jones, son of Dr. W.C. Jones,
will graduate next Thursday from the
Cooper Medical College at San Francisco. He stands among the highest
in his class and has been offered the
position “of assistant instructor in the
pathological department of the institution.

GRASS VALLEY WINS,

In the case-of Charles Klein against
the city of Grass Valley, te collect $298
damages, Justice Hlolbroo’s this morning gave defencaut judgment for its
costs. :
In May }: trustees of Grass
Valley took av. Aieii’s license on the
ground that he kept a disorderly house.
This was done without giving him any
trial or notice. He took the matter to
the Superior Court where it was held
that such action was illegal, the trustees having no jurisdiction in the
premises. Inthe meantime the saloon
remained closed for fifteen daysAfter they had restored the license
Klein brought suit in a justicécourt to
recover $298 damages. A change to
Justice Holbrook’s court was’ obtained
and last week the case was argued.
The City Attorney took the ground
that Grass Valley was a part of the
State government and was .not responsible for damages ‘caused by the
illegal acts of its trustees. He cited
various Supreme Court decisions to
sustain his position und his bonor
agreed with him.
