It was also held that the identity of
the old Granite ledge location made in
1862, and the relocation in 1882, was
not established.
That after the issuance of. the townsite patent the location had been shifted soas to embrace land which was
not originally included, and as a min.
ing location made subsequent to a
townsite patent could not affect the
townsite claimants’ title, the claim of
defendant must fail.
This is one of the most importent
cases that has been decided wherein
there was a conflict between mineral
and townsite claimants. The townsite
people obtained their patent 25 years
ago and had made improvements on the
land by the erection of dwellings, etc.,
to the amount of $20,000. The decision
gives them their homes, but it does
not affect that portion of the Granite
Hill claim which is patented: and has
the company’s improvements upon it.
The plaintiff's attorney was A. Burrows of Grass Valley, the defendant
being represented by J. M. Walling of
this city. :
Itis not improbable that the case
will be appealed to the Supreme Court.
