Judge: Nilon's Decision in the —_— Granite Hil Case, The Townsite Patent to South Grass Valley Superior to the Mining © Ryau‘-vs. Plaintiff as grantee of a large numThat under the decisions of the U for minerals at the date the patent was this act does not mean merely lands worked, or one that under the prevaildevelop into a paying mine. small quantities, or quartz that conprive the townsite claimant of his title. and scores of miners had taken turns patented and which is outside of the townsite, and upon which almost all the development work was dome, has never yielded more than was expended upon it in developing and extracting the ore. ose That the land in ‘controversy is not now and never was mineral land that would pay for working, and therefore was not exempted from the operations of the townsite grant;. but the title to the same passed to the several town site claimants. : It was also held that the identity of the old Granite ledge location made in 1862, and the relocation in 1882, was not established. That after the issuance of. the townsite patent the location had been shifted soas to embrace land which was not originally included, and as a min. ing location made subsequent to a townsite patent could not affect the townsite claimants’ title, the claim of defendant must fail. This is one of the most importent cases that has been decided wherein there was a conflict between mineral and townsite claimants. The townsite people obtained their patent 25 years ago and had made improvements on the land by the erection of dwellings, etc., to the amount of $20,000. The decision gives them their homes, but it does not affect that portion of the Granite Hill claim which is patented: and has the company’s improvements upon it. The plaintiff's attorney was A. Burrows of Grass Valley, the defendant being represented by J. M. Walling of this city. : Itis not improbable that the case will be appealed to the Supreme Court. G0 Justice Court Notes.
