public streets, alleys and highways of said Nevada City, fora period of twenty-five (25) years

WHEREAS, it is proposed to grant the same to
the highest bidderin the m.nner provided by
law.
Now, THEREFORE, BE It RESOLVED: That the
Clerk of this Board be, and he is hereby in
structed, to advertise. in. the DaILY TRasSCRIPT, a newspaper published in the City of
Nevadn, State of California for ten (10) eonsecutive days the following notice of intention to
award a Frauchise granting the aforesaid privyileges to the highest bidder, in the following
words, to-wit :

twenty-five (25) years, and that it is proposed
to g:ant the same to the highest bidder, and
that the said Board of Trustees wil, on the
28th day of March, 5805, at8 o'clock P.M,
meet in the City Halt of the City of Nevada, in
open session, for the purpose of opening sealed
proposals forthe purchage of a Franchise of
the character aud for théfterm set forth below,
at which time and place’ said Franchise will be
awarded to the highest bidder.
Bids will be received by the Board for the
purchase of the said Fraochise up to 2 o'clock
p. M. Of March 28h, 185, aud all bids must be
accompanied by a check for the amount of

The following is a copy of the Ordinance,
which is proposed to be passed, awarding to
the successiul bidder the aforesaid Franchise,

do ordain as follows:
SECTION 1,
The City of Nevada hereby grantsto... .

Said pipe or conduits te be laid underground
in a workmanlike manner as wot to interfere
with trayel upon said streets.
SECTION 3.
The said grantee or assigns may make all nec@seary excavations in any of said streets, highways oralleys forthe purpose of maintaining

and said work shall be done in compliance
which hy during the continuance of this
Franchise adopted from time to time by the
Board of Trustees of ssid City, end shall be
done to the satisfaction of said Board of Trustees.
SECTION 4,
Nothing in this Ordinance shall be construed
as in any wise to prevent the proper authorities
of said City of Nevada from sewering, wrading,
paving, repairing or altering any of said streets,
alleys or thorough fares,
SECTION 5.
The rights, privileges and Franchises herein
granted shall continue and be in force for the
period of twenty five (25) years from and after
the date of the passage of this Ordinance.
SECTION 6,
‘ Work on said Gas plant shall be commenced
within One Year from date of the pass.ge of
this Or&ginance, and completed within’ two
years from the date of the panes of the same,
and in default or neglect thereof this Franchise
shall be forfeited.
SECTION 7,
The Ordinance shall take’ effect and be in
force from and after twenty days after its pas

The Board of Trustees of the City of Nevada
do ordain as follows: { ;
SECTION 1. The City of Nevada hereby grants
to the Sunset Telephone and Teiegraph Co., its
successors and gna, the right and privilege to
place, lay, erect, maintain and operate in the
streets, alleys and puolic bighways within said
city, poles, wires and other conductors for the
transmission of electricity for telephone and
telegraph purposss.
SECTION 2. Such wires or conductors shall be
‘. stretehed upon poles or other fixtures above
ground in a workmanlike and proper manner;
said poles shall be erected at the edge of the
sidewalks in said City.in a good and substantial
manner and shall be painted. Said grantee and
its assigns shal) cause a wire to be placed in the
City Hall of said City with a proper receiver
and transmitter, which they shall keep in good
eondition and which s be open to use of the

or police or fire alarm purposes, free of charge.
The Board of Trustees of said City shall have
the right to cause said grantee to move the location of any pole whenever the public convenience shali require the location of the same
elsewhere; the expense of such removal to be

SECTION 8. The said grantee, or cnens, may
make all necessary excavations in any, of said
strects, alleys or public high ways for the purpose
of erecting sod maintaining poles or other supports’ for said wires or conductors or repairing
the-same, and said wotk shall be done in compliance with the necessaty rules, regulations,
ordinances or orders which may, during the
continuance of this Franchise be adopted from
time to time by the Board of Trustees of said
City, and the same ghall be done to the satisfaction of the said Board of Tru :tees.
SECTION 4, Nothing in this ordinance shall
