Tbe eminent jurists said that the only . reason for calling the grand jury was the clause in the Constitution of the State of Culifornia that required the calling of the grand jury at least once in each year. In their charge to that body the Judges also said: ‘We believe the sentiment to be very general in this State that the present grand jury system has outlived its usefulness and that its continuance isa needless burden on the taxpayers of the commonwealth. “No doubt it has in ‘the past performed valuable functions in the administration.of criminal law, but this consideration appeals rather to antiquarians and students of political history than to the property owner seeking relief from heavy taxation, .These same functions can now be performed with less expense, efficiency, and more in accordance with the spirit of our in-gtitations by the District Attorney, aided by the examining magistrate and ‘the machinery of modernized criminal ~ jurisprudence already established.” The same sentiment prevails almost nnanimously in Nevada county.
