A Sacramento Girl Praised.
Miss Kate Heyman, a Sacramento
girl well known at this city, who has
achieved unusual prominence as 4
pianist, is at present in Canada. The
Mail-and Express of Toronto, Writing
of a concert at which Miss Heyman
was one of the performers, says this of
her rendition of Wagner’s “Die Walkure:” “Jt is music that grows on one.
Miss Heyman is indeed a most exceptional performer, with strong individao-.
ality, backed by power, technical equipment and a fine intelligence. Her rendering of the: Rachmanioff prelude, a
solemn and lovely composition, was
exquisite.”

The Jury Recommend Robert Hooper to
the Morey of the Court.
“The case of the people against Rob_. ert. Hooper, charged with the murder of . §
Mark Oarey, which began in the Sh. perior, Court last Friday morning, was
‘given to the jury late yesterday afternoon, The charge of the Judge oceupied an hour and minutely covered
every point in the case. As the jary
failed to agree at midnight they were
locked up for the night and appeared
before the court this morning. The
tothe Judge, declared that they had
failed to agree on a verdict and would
probably continue to do se. The Judge
inquired how théy stood and was informed that they stood 11 to 1. The
Judge informed them fo retire fora

Judge promptly informed him. ‘that a
‘person must in all cases follow his own
cohscience and ought not to allow himself to be influenced by the fact that
_. the balance of the jury differed from
him.
At 11:45 the jury asmeiiioet that
they had agreed and were again taken
into the courtroom. They found the
defendant guilty of manslaughter and
recommended him to the mercy of the
edurt.
It is reported that at the outset the
jury were about evenly divided between murder and manslaughter. One
of them continued. to vote for acquittal to the last and: compelled the balance to recommend the accused to the
mercy of the court, a recommendation
that will be respected without doubt.
‘The hold-out juryman seems to have a
slight knowledge of law, and on this
account was rather technical and slow
to agree with the others. One juryman in. speaking of this fact remarked
that “alittle learning is a dangerous
thing.”
The fact that the accused shot his
victim in the back and continued shooting him after he fell rendered a verdict
of not guilty out. of the question. The
penalty for manslaughter is imprisonment in the State prison not to exceed
ten years, but in this case a very light
sentence is expeeted. ‘The case was
fought by both prosecution and defense for all that was in it. Not a single “break”: was made by either side
