The Insurance company’s attorney, Joseph C. Campbell, appeared in Igdge McKenna’s court yesterday morning . and asked permission to amend their answer to the complaint of Mrs. McWhirter, who ia epdeavering ta recover the money. By the answer previously, filed the insurance r y. intends to prove that Louis McWhirter killed himself, and by a clause in the policy the holder of it forfeits his. contract. Attorney Campbell said yesterday that he hed abundant evidence to prove that McWhirter committed suicide. and when the case is called. next Tuesday in the United States Circuit Court he would have his witnesses on hand to prove that to be: fact. If be does, that will end the accusatiop. against Richard Heath, who passec through the ordeal of a trial last summer but escaped conviction by one of the jury men objecting te. verdict of guilt. A new trial was ordered and the accused man is now enjoying his liberty under $75,000 bail. Outside of the suicide theory the ‘in* surance sompany claim that McWhirter concealed the fact from them that threats had been made against his life when applying for his policy, and that also voids the agreement between themand MpWhirter's estate.
