A SIERRA. COUNTY CASE,
A Decision by the Supreme Court of
Considerable_Interest.
The Supreme Court has decided the case
of James C. Weir et al., respondents, vs.
Michael H. Mead, defendant, and Benjamin
Pauley et al:, appellants. Hiram G. Weir
died in Sierra county and named Mead as
the executor of His will. Mead tiled a bond
and took out letters of probate, but did not
“sign the bond himself, although ‘the six
~ sureties did. Mead’s final account was set~
tled .and:.a. distribution of $1,262.69 to the
heirs ordered, but he never made it, and the.
‘heirs sued him and his bondsmen; Mead)
did not appear, and the bondsmen set up
the defense that, as their principal did not
sign the bond, they were not holden on it
Judgment was given against them, and they
all, except Mead, appealed.
After quoting various decisions to. the
effect that the sureties are not bound because
the principal did not sign the bond, Commissioners Searls, Belcher and Hayne —recommend that the judgment and order be
reyersed and the cage be remanded to the
court below, with iustructions to find for
the appellants, andit' is so ordered by
Judges Hayflon, Garoutte and Patterson.

drama, ‘‘The Spy of Atlanta,” at. Van's
Opera House Saturday evening, the performance being witnessed by a crowded house.
It was & successful and highly satisfactery
entertainment. “We learn from parties who
were in attendance that the members of the
dramatic cempany, one and all, acquitted
theméelves-with credit. Especial praise-is
given to Elmer E. Black, who assumed the
title role. My,’ Black is the atar of the
company. ¢* js a good elecutionist and
possesses. iderable dramatic ability.
G. H. Pletcher,Miss Flora Huss, Miss
Powell, Mrs. C. W. Kitts, and Henry J.
Campbell sustained their respective parts in
a praiseworthy manner, The play itself is
very interesting, being replete with thrilling
and affecting scenes of war. times, Every
detail was faithfully, carried out, and all
who attended the entertainment were delighted beyond expectation.
