here are about a handred guests at
. fort and Harry Day came to this city
him over to the authorities provided
only today, through Constable Kelser
who returned from Indiana Ranch, did
the Sheriffs office and District Attorney McDaniel learn, of the matter,
prisoner’s name is Harry Day and that
he has a partner in the crime. Both
men were in the employment of the
Good Title Mining Company, and when
they struck the rich pocket could not
resist the temptation, there being no
overseer in the mine, Their peculations they buried ina hiding place, and
when Day’s partner learned of his arrest he took the gold and went to
Brownsville, A warrant has been issued for his arrest, and it is* yet possible that both men will be lodged in the
county jail. The manager of the mine
told Constable Kelser that the pair will
-be allowed to go free if they produce
the gold. When Day was brought to
‘the hiding place and learned that it
had been taken away he cried bitterly,
bewailing the disgrace his conduct will .
bring on his aged mother and sisters.
Constable Erwin of Dobbins has Day
in custody.”
Yesterday morning’s Appeal says
about the case: ‘
“A detective has. been employed for
the past three weeks by the Direetors
of the Good Title Mining Company at
Indiana Ranch to watch some of the
miners who were . suspected of stealing
gold from a pocket to the value of
about $900. John J. Dailey, R. D. Crawlast Saturday night, and after they had
left a lawyer’s office it was rumored
that Day was in trouble; It was.ascertained yesterday that Day had admitted
that himself and another .man had
buried the gold, and that later his partner had dug up the money and started
for Brownsville. District Attorney
McDaniel informed an ‘Appeal reporter
that he-had issued no complaint, and
that he was not aware that a Deputy
Sheriff had brought any prisoner to
this city last Saturday and then allowed him to go. The Manager of the
miné told C. C. Kelser when he was at
Indiana Ranch on Monday that the
men would not be prosecuted if they
returned the gold. The detective employed at the mine was one of the three
men that came to.this city, and Attorney Carlin states that they only consulted him about the Dailey case ‘that
commences in Judge Garber’s court
next Monday: . They had, however,
spoken to him sevaral weeks previous
about the robbery at the mine, and at
that time the amount missing was ‘less
than $1,000. Day was not under arrest
while in this city; he slept ina room by
himself at the Western Hotel, while
Dailey and Crawfort occupied another
room. If there was a felony comdoubt thoroughly investigate the matter.” *
