SOLDIER LOCATORS SAFE.
Their Claims Exempt From Annual Labor Until They Return.
Senator Shoup’s bill exempting locators of mines who volunteer in the
army and navy from proving up so
long as they are in the service, and allowing their rights to ‘stand until the
expiration of their enlistment, has become a law by the approval of the. .
President. It was sent to the House
aiter passing the Senate, was amended

Wednesday the President affixed his

know that it is now a law.

The Democrat says: D. P. Durst and
W.T. Phipps have instituted proceediugs in the Superior Court of Yuba
county against 8S. O. Gunning, Auditor,
'to compel hin todraw a warrant in
their favor in payment of services that
have been performed for the county
during the month of May. The claim,
$200, was audited at'he June session
of the Board and is for anti-debris ser.
vices.
it will be remembered that in March
last D. P. Durst commenced an action
against Gunning to compel him to
draw a warrant in payment of the January service. The lower court held in
favor of plaintiff, and the matter is on
appeal to the Supreme Court.
» When asked why hedid not await the
decision of the higher tribunal on the
first case, Attorney Phipps stated that
1ne new suit differs from the old one in
that it is brought under a new resolution of the Supervisors, which employs
him jointly with Dr. Durst and which.
difference he believe makes the new
_. complaint less liable to legal inaccuracles.
