The franchise and privilege is hereby granted to pace his heirs and assigns, to construct and operate a street railroad along and upon the County road between the corporate limits of the City of Nevada and the City of.Grass Valley, by way of Town Talk, in said Nevada County, said railroad to be opera by either electric power, steam power, A ageshonl derived from compressed air, liquid air, underground cable, horses, mules or other approved method of transportation, over and upon the following route: “Commencing on the eastern boundary line of the corporate limits of the City of Grass Valley, at the junction of Main Street and the Grass Valley and Nevada City turnike; thence slong the Southerly side of Gras Valley and Nevada City Turnpike to the Idaho road; thence curving Norther} to the Westerly side of the Grass Valley an Nevada City Turnpike; thence Northerly along the westerly side of the Grass Valley and Nevada City Turnpike to the Southerly line of the propersy. of Roger Shackleton and Charles Shackleton; thence leaving the County Road, Northerly and = Easterl at de, and upon private property, by an with the consent of the owner, to the Northerly side of the old Hughes road; thence through and upon private property, by and with the consent of the owner, to a point sixty-eight (63) feet Southerly from the iron fence in front of the residence and property of Richard Noell, intersecting the County Road ; thence Northeasterly along the Northwesterly side of the Grass Valley and Nevada City Turnpike toa pains opposite Glegbrook Park; thence again leaving the Road, curving Northerly into and upon private property. by and with the consent of the owner, pass ng through and upon sam on such courses as may afford a practica grade for the operation of cars to Town Talk; thence along the Nortwesterly side of the gorporste limits of the City of Nevada. Said railroad to consist of either single or doub’e track, with necessary turnouts and switches; provided, however, that in no case shall a double track or turnout be laid on said County Road, where said road is not at. least forty feet in width. SEOCTION?2. The ties and rails_of said railroad and all turnouts and switches shall beso placed as to afford no unnecessary obstruction to travel on such County Road, ard the same shall beso located on such route.as shall be directed by, and to the satisfaction of, the Supervisors of the and second supervisoral districts of said Neyada County. If the said Road sh be operated by electric sha'l ponre. the same shall be operated by overead trolley system, andthe poles carrying the power current shall be set in a safe, substantial. and workmanlike manner, ‘and sha!l be sufficiently removed from the traveled part of said road so as not to interfere with the travel thereon, aud wires shall be so strung on said poles in a manner to prevent their coming to the ground. SECTION 3. The said grantee and his assigns shall pave or macadamize the travel part of said County. Road between the rails, between the tracks, and for two feet each side thereof, with the same material used by the County, upon the highways over which the road runs respectively, and keepthe same constantly in repair, flush with the highway and provided with suitable or ssings; and shall make the road bed conform at ali times to the established grade of the said highways; all repairs and grades to be made under the instructions and to. the satisfaction of ‘said Supervisors of the first and sec supervisoral districts. {n ease the said grantee or his assigns fail to e mply with the instructions given by said officers for ten days after service thereof upon the agent of said grantee, resident in said Nevada County, the said Supervisors, or their employees, may enter upon the road of said grantee and do the work as ordered by said Supervisors; said Supervisors to keep an itemized account of the cost of said work, which said grantee, by the acceptance of thisfranchise hereby agrees to pay immediately upon its presentation to said grantee’s local agent stationed in said Nevada County. SECTION 4, Cars shall be run over the road constructed under this franchise during every day, unless prevented by the elements or unavoidable accidents, or for reasons over which the grantee has no control. Provided, further that cars shall be operthan one hour between the hours of 7:30 a. m. and 9:30 p. m. each and every day, unless prevented by the elements or unavoidable accidents, or tor reasous over which the grantee has no control. SECTION 5. The said grantee, and his assigns shall cons‘ruct all necessary filumes and culverts for the free passe e of water under the tracks of said railroad, where the same naturally flows; and all curves, aqueducts, turnouts and‘witches shall be constructed under the plans and specifications approved by the Supervisors of the first and second supervisoral districts aforesaid. ““SEOTION 6. The County of Nevada, in making the gFant of this franchise, expressly tersen theright to pave, macadamize, renew or sewer any of said highways, or to lay gas, water or other pipes therein, such work to done so as to injure said railroad as little as pessible. SECTION 7, Provided, further, that the cars upon said read shall aot be allowed to stand on the highway, or highway intersections in such a manner ag to Obstr uct the use of said highways by vehicles, SECTION 8 ** That the rate of fare, one way, for any distance along said Tonk or along anit ced and any connecting line or lines leading to or inte the City of Grass Valley, or to or 2 od the City of Nevada, in said County, and operating under said franchise, shall not exceed fifteen cents for one passenger. _ BROTION 9, .
