Will Relinguish Mineral Grounds Without Bee Compensation. Hon, W. H. Mills, Land Agetit foe the Southern Pacific Railroad Company, writes to F. H. Wehe, District Attorney of Sierra county, a long letter in relation to lands held by the Railroad Company, from which we make the following extract: ~«We have adopted every device to~prevent the-prima facie title of the company from obstructing mineral operations. I have already indicated that where mines are found in odd numbered sections, wes _relinquieh without compensation the title of so much of the land as is covered by the mining claim and enough for the convenient working of the mine. We recently relingnished eighty acres to 4, mining compaoy in .E] Dorado county. We keep a record of those relinquishments which is open to inspection. ‘here are over two hundred cases of voluntary relivquishment without consideration infavor, ot miners, and in very cases, no mines ‘wert eventually found. . The company has pursued the policy of encodraging mining anywhere in the State What it has resisted is the attempt of persons to have large areas of land, in which at many intervals minerals are found, withdrawn from public occupation or settlement for the benefit of. nomadic prospectors. Immediately contiguous to mines, there is sometimes agricultural land of the finest quality, and land should be devoted to its highest use. Every interest of the company is completely identified with the interests of industry of every kind. There are communities of this State which would be-without population but for mines; and the railroad is serving these communities with transportation, On the transportation side of the account, an actus] operated mine pays far moe to the ratlrord: than. the value of the land, even though it should be a profitable mine. We are often called upon to resist the claims of p up land under the pretense 6f mining, tending to take timber under the pretense that itis mining land. There are many 1nstances where patents. have for mining land, and the jand immediately Parties taking ip this ople who tak: Inbeen obtained planted to orchard. way have exhausted their homestead and-are not eligible to take land in apy other way than by mining claims. There are single mining corporations in this State holding from 1,000 to ,000 acres of Jand, chiefly timber land. The question has been asked: ‘‘Could you inform me whether, or not, it will be possible in such cases to get an agreement from the company to the effect that if ‘the patent is issued the company will convey to the’ owner; and, if so, upon what terms ?”’ Permit meto say that if the land is actually mineral, it is not patentable to the It is not actual mines, as already right. company. indicated, that will give.us trouble in this matter, It is mining prospects, nine out of 1895.
