HE SUPREME COURT of the United States hae just settled the question: “Has Congress the power to prohibit the sending of lottery tickets from one State to another by any other means than the mail?” Ia two cases before the court the copstitationality of the Act of Oongress of 1895, prohibiting the sending of lottery tickets out of one State into another by express, was challenged. The contention of counsel for the defense was that the inhibition is not « Federal function and is not one of the powers delegated in the Constitution by the States; that the eending of the lottery tickets or policy slips is not an act of interstate commerce; that the suppression of lotteries belongs exclusively to the police power of the several States. The Supreme Court held, Justice Harlan delivering the opinion, that _ transmitting lottery tickets from one State to another as matter of traffic is an act of interstate commerce, and that the Act of Congress prohibiting the car well known bymn rying of such articles is withia the regulative powers of the Federal Government; therefore, Congress may take cognizance of the traffic as an interstate commerce act, and it is not compelled to tolerate itin order to regulate it. The Supreme Court holds that Congress, for the protection of the people “ef all the States, under the power of the Interstate Commerce Act, may dev means not probibited by the Conetinties, to drive the traiie out from among the States. ‘The decision is . a majority one, ‘four of the Justices dissenting on ‘the ground that the holding of the majority is inconsistent ‘with the views of the framers of the Constitution. This decision interposes the most powerful obeck that has yet been applied to the traffic in lottery tickets. They have long been exclpded from the mails, and the transmission of them in any other way from one State to another is now held to be a violation of the law subjecting the trafficker to punishment ander the Federal law. It is thus developed that the United States is far in advance of the States in this matter of crushing the lotteries, It hag gone now tothe full extent of its power and thus ‘indfeated to the States that they, too, may suppress the lottery evil, if they choose to exert their local police power, supplementary to the action of Congress, or initiate and originate means for its ‘suppression. But so far as Oaliforuia is concerned, it is quite improbable that anything will be done to stamp out the business which the Constitution aud the statates ~ denotes as Criminal, and both of which demand its suppression. In thie State it is as directly against the statutes to advertise lotteries as it is to do upjastifiable killing of human beings. No sort of pettifogging can moeke it appear that the methods employed here are not those of plain, highly paid for, unconcealed advertising. The leading daily papers of San Francisco, which pose as moralists and prate daily and loudly npon the street corners about enforcement of the lawe and the accomplishing of reforms, are defiant violaters of the lew of the Constitation and of the statue book. Bat the hand of the law is absolutely paralyzed in the matter of compelling obedience to it from these newepapers. DDIET MENTION. In the Superior Oourt this morning the charge of rape which has been pending against J. R. Ballestero for several months was on motion of Distriet Attorney George L. Jones dismissed and the defendant given his freedom. The bondsmen were also discharged. In making the motion Mr. Jones stated that in his opinion a conviction could not be secared and he deemed it his duty iu justice to the texpayers of Nevada county, to move for a dismissal. He mentioned the fact of the defendant baving been . . already tried txice on this charge, in both of which the jury disegreed, and of the trie] of Charles P. Schenk on practically the same charge in which the jury also disagreed, and forthat reason he did not think it possible to secure a coviction. Before granting the dismissal Judge Nilon took oocasion to make a few remarks in which he said that he did victed, and that it would be a very heavy experse to the county to try the case again. He thereupon granted ‘the motion for dismissal, Io making this motion for dismissal the District Attorney showed good jadgment, and is entitled to the thanks of the texpayers. — It fe generally understood that both . John Wright, a resident of Trackee, was brought to the county hospital to day, suffering from a fractured leg. While walking along the wooden thoroughfares of that town he accidentally . © slipped and fell, with the above result, George Worthley was also brought over from Truckee. He is afflicted with an aggravated case of bronchitis and comes to seek medical treatment. The Nevada Oounty Hospital is now well patronized, 89 patients being dcmiciled at that institation. Moody testified that it was simply a cave that came down and caught Mr, Walters, and it occurred about two o’clock. ~Stortly before that time the bank appeared safe Superintendent Olifford Graham of the Oanfleld mine testified that the accident occurred about two o'clock, Anambolat, De and that Walters was working in an Colusa, Batte open cut when the bank of earth came down and covered him up with five or six feet of earth. Mr, Graham said he was about one handred yards distant when he saw the bank giving
away and gave warning to the men, but Walters was not able to get out of the way. No-biame conld be attached to anyone, and the cave was purely accidental, I. Oorbett testified that he was working near the uofortuoate man when the cave came and ran for his life. Theré were five men working at. the time and all except Walters escaped with their lives. E. B. Stevens was caucht but escaped injury, and Archie Noyes was caught and slightly injured.
