James Kelly, who was arrested yesterday ona charge of having a ton of quartz hauled from the St. Louis mine on Canada Hill to Locklin’s mill, without permissicn from the owners, was released froya—cuatody last] evening pending an examination inte the case. Kelly and others have been working the Monitor quartz mine in Willow Valley, and had two and three-quarter tons of quartz op the dump which they were about to have crushed. Jerume O’Hearn, who was one 0! the partners in the Moniter, asked to have a ton of private rock, which he said he had found at an old abandoned mine on Canada Hill, ‘ernshed along with the other ore. This was agreed to and Kelly helped load When it was learned that the tock had been taken, S. B. Mosby, one of the lessees of the property,, swore out a r complaint against Kelly and O’Hearn. The former was arrested, but the latter has thus far eluded the officers. Kelly says he had the quartz. no intention of stealing anybody's quartz, and supposed O’Hearn had-a right-to it: Sheriff Douglass gave him the following note, addressed to J» C.
