knowledge to know that there is a
cheaper and more pleasant way of inGreasing brain power than can be
found in fish diet. I was startled by
hearing a physician say lately: ‘Our
brain is only half developed, anyhow;
we are right-handed and left-brained,
the right side of the brain being practically unused, just as the left hand.”
“Atthat rate,” said the patient, “our
gymnasts should have well-developed
brains, as, with the practice on dumbbells, Indian clubs, the horizontal bar,
trapeze and other muscle manufacturers, the left and right arms are equal-°
ly developed.” ‘That is quite true,’
said the medicine man. ‘‘Gymnaste

something more than physical exercise is required to produce intellectual
results from an.excellent physical
brain. Ambidextrous men are apt to
beemart fellows if they give themselves any kind of a show. For instance, President Garficld, when he
was teaching school, acquired the habit of drawing on the black-board very
rapidly with both hands at the same
time. Thereis a very distinct relation between the left side of the body
and right brain, as also between the
left brain and the right side, but it is
hard to say how many hours exercise

. Hon. Phil; W. Keyser took his seat
in the Superior Court at 10 o'clock
this morning, at which hour the trial of
the Omega hydraulickers had been set
for hearing.
Frank W. Stone, their attorney,
raised a preliminary objection that the
word Supreme Court appeared in the
complaint instead of Superior Court.
District Attorney Forbes moved to
amend.
The affidavit of William M. Oyster
was read by the District Attorney
which showed that an injunction had
been served on defendants, after which
they did work the Omega mine and
discharge slickens ‘fittothe Yuba river.
An attachment was then issued from
the Superior Court that as they had
violated the injunction the sheriffs
were bound to arrest and bring said
parties before the Court on Wednesday,
April 24, 1889.
The District, Attorney proceeded to
‘ask the Chinamen their names,. and
acting on the instructions of their attorney they declined to.anawer.
W. M. Oyster was sworn, In reply
tothe District Attorney lie said he was
Deputy Sheriff of Yubacounty. Identified all the défendants as the men that
he had served with an injunction on
April.3d, while working the Omega
mine.
Frank M. Stone wanted the Chinamen tagged, as the witness identified
them by the fictitious names.
Judge Keyaer refused this application.
Mr. Oyster then identified the entire
number. He said that after being
served with the injunction they continued in full blast, using three monitors. The tailings were emptied into
the-South Yuba, The Omega mine
was in Nevada county. (District Attorney Forbes handed in several exhibits which were marked by the
Clerk of the Court. They were taken
from--Scotchman’s creek atthe time
the defendants were mining and after
the Injunction was served.) Had a
conversation with the defendants
when he served the injunction. They
said they would not stop, as R. W.

J. A. Saul, Sheriff of Yuba county,
was then sworn, Mr. Stone asked
him the names of his. deputies who
made the arrest.
District Attorney Forbes objected.
Judge Keyser allowed the objection.
District Attorney Forbes was then
sworn, and was asked by Mr. Stone if
he had received a letter from him,
and he answered ‘“‘yes,” The letter
was read.
Mr. Stone said he desired to offer in
evidence the reply he receiyed which
he read, and which was in substance
that judging by the past he had no
confidence in a Chinaman’s good faith,
The case was submitted without arguinent.
Judge Keyser found each of the defendants guilty of contempt, and fined
the twenty Chinamen $500 each, or to
spend one day each in the county jail

Thursday evening there was trouble
‘. with a young man from Gold Flat
whom Salvationist Clemo said was
noticed the restraining works below
the mine. The slickens was flowing
over. On cross examination by Mr.
Stone he said he was living in San,
Francisco the end of last year; went
to Omega on'the 24th of January and
remained there until” the 19th of
March; came to Marfaville for a few
days and returned to Omega on April
3d; remained there until the night of
the 6th, when he came to Marysville,
and paid a short visit to Stockton ; after
returning to Marysville visited Nevada
City, and again returned to Omega.
. The District Attorney objected to
this mode of examination.
Judge Keyser allowed the examination to go on, 4
Witness had served no white inen in
Omega, and had received no consideration. Hesaw them working and had
informed the District Attorney of Yuba
county of the facts; was not present
when defendants were arrested.
Mr. Stone raised a lot of objections
to identification, but they were overruled, Witness continuing, said he
identified the Chinamen by their
faces.
Mr. Stone said none of his clients at
present in Court, understood English.
Judge Keyser said he never yet met
a Chinaman who admitted on oath
that he understood Englisty.
On re-examination by the District
Attorney he said hé‘had served papers
serve then on the white men was
because he had not papers enough.
_/ Seorge R. Grant was then examined, and identified all the Chinamen,
He worked with the Chinamen after
the injunction was served, The dam
that had been constructed filled up
with debris, and was useless for holding the debris, asit went over it, The
mine was worked by the hydr:ulic
process. He was running one of the
monitors; came into Court in obedience to a summons ‘served upon him;
they used about 800 inches of water,
except in a storm, when they used
more; toldthe boss they had better
raise the dams, On cross examina;
tion he said he had been summoned
by Taylor, Boyd, who told him he was
to receive his expenses and $5 a day,
and that no trouble would come to
him, : ‘
The District Attorney closed his case.
THE DEFENSE,
Mr. Stone outlined his defens-,
which was in substance that Mr. Tully, who leased the Chinamen the
Omega mine, promised to build such a
dam as would protect tnem from all
harm, He claimed that the dam was
built, and thatthe Chinamen were informed that every thing was all right.
He said that the Chinamen were
ignorant of an injunction b -ing served,
and that when they learned of the
facts they shut down the mine.
Frank M, Stone was then sworn and
identified a contract between K. W.
Tully and the Chinamen who leased
the mine, — :
Jeter Jaspen was next sworn and
was asked if any of the defendants
were talked to about the injunction,
and he answered ‘‘no,”’ Tie people
who resided in Omega, did not think
an injanction was served, The water
was shut off on April 10th,
