Stone, their attorney, raised a preliminary objection that the word Supreme Court appeared in the complaint instead of Superior Court. District Attorney Forbes moved to amend. The affidavit of William M. Oyster was read by the District Attorney which showed that an injunction had been served on defendants, after which they did work the Omega mine and discharge slickens ‘fittothe Yuba river. An attachment was then issued from the Superior Court that as they had violated the injunction the sheriffs were bound to arrest and bring said parties before the Court on Wednesday, April 24, 1889. Oyster was sworn, In reply tothe District Attorney lie said he was Deputy Sheriff of Yubacounty. Identified all the défendants as the men that he had served with an injunction on April.3d, while working the Omega mine. Frank M. Stone wanted the Chinamen tagged, as the witness identified them by the fictitious names. Judge Keyaer refused this application. Mr. Oyster then identified the entire number. He said that after being served with the injunction they continued in full blast, using three monitors. The tailings were emptied into the-South Yuba, The Omega mine was in Nevada county. (District Attorney Forbes handed in several exhibits which were marked by the Clerk of the Court. They were taken from--Scotchman’s creek atthe time the defendants were mining and after the Injunction was served.) Had a conversation with the defendants when he served the injunction. District Attorney Forbes was then sworn, and was asked by Mr. Stone if he had received a letter from him, and he answered ‘“‘yes,” The letter was read. Mr. Stone said he desired to offer in evidence the reply he receiyed which he read, and which was in substance that judging by the past he had no confidence in a Chinaman’s good faith, The case was submitted without arguinent. The District Attorney objected to this mode of examination. Judge Keyser allowed the examination to go on, 4 Witness had served no white inen in Omega, and had received no consideration. Hesaw them working and had informed the District Attorney of Yuba county of the facts; was not present when defendants were arrested. Mr. Stone raised a lot of objections to identification, but they were overruled, Witness continuing, said he identified the Chinamen by their faces. Mr. Stone said none of his clients at present in Court, understood English. Judge Keyser said he never yet met a Chinaman who admitted on oath that he understood Englisty.
