Emeric, Fish ‘and. Game Commissioner, when he found that there was abundance of trout in the lake, coveted it with the covetousness of an angler. ~ He thereupon, bought eighty acres from the railroad company and eighty acres from a man named Wilson. This gave him possession of all the lake frontage except one acre, and this acre guarded the entrance to a sifall inlet containing a brook in which the trout were accustomed to spawn at the nearly every month in the year. proper season. It was evident that Mr. Emeric could not acquire the monopvly of the lake and its contents,-so long as this acre of frontage belonged to somebody else. That’ somebody else was George W. Mills, a cattle and sheep raiser, who was perfecting a Government homestead title to the land of which the coveted acre was a part, Mills’ sheep and cattle used to walk through the acre and drench their thirst in the clear waters of the lake, in full view of the Alpine cottage erected by Fish Commissioner Emeric; and in the full gaze of his seléct and aristocratic friends. So Commissioner Emeric did what many arich and grasping man had done before him: Hesetin motion the machinery of the law in ‘order to take that acre of: lake fcont, valued at $2.50, away. from Sheepraiser Mills, and filed’ an application for the forty acres on which the one acre was situated, alleging that it was timber land, not fit for agriculture, and that therefore, Mr. Mills’ improvement and occupancy of the premises under the homestead law were a fraud, a delusion and a snare. The case canie before Receiver Charles F, Gardiner and Receiver Thomas Frazer in the F. H. Gould and E. D, McUabe appearing for Emeric, and Joseph W. Hughes and E, F, Taylor for Mills. the forty acres as timber land, the evidence being all one way and to the effect that there was not enotigh timber on the forty acres to keep'a match factory in operation It was also testified that no one would take any of the tract for. timber, and that the land in that neighborhood was leased for pasture at from $20 to $30 per section of 640 acres per year, for a month. himself admitted on the stand that all that he cared about was the acre of lake front, and that only for the trowt, and that he bad no intention-of going~into the lumber business with the coveted forty acres as a basis. The land office took the case under advisement, There will be. much curiosity to observe what decision will berendered in this interesting suit.” : — is@e ees Forgot He Hadn’t Been Married. Not long ago. he remarked tu one of the students: ‘‘Something very stupid happened to me the other morning, I believe I am becoming a little absent-minded.” ‘What is it? inquired the student. ‘You see,” explained the professor, gravely, ‘‘I wanted to take my wife out for a drive and give her some fresh air, but when .I came to make preparations I suddenly remembered that-I never had a wife!” Neary all women have good hair, though many are gray, and few are bald.
