THE NEW PRIMARY LAW.
A plainly written explanation of the
now eléction law, particularly that portion govering primaries, would be appreciated by the mass of votes just
now, says the Stockton Record.
Some of the provisions are differently interpreted by attorneys, and, like
something new cin generally be found
by those looking for it.
It is unders ood, however, that the
Supervisors must appoint the judges
uary, and, as the power rests solely
with the Board, the committees of the
political parties will have very littie tc
do with it.
The various party tickets at the pr:maries will be designated by color, the
list of delegates of each party receiving
the highest vote to be duly accredited
delegates. The voter will have to be
on the register, so that floaters will
stand a poor show of getting ina vote.
The efforts of various parties to hold
their members in line and prevent outsiders getting in their work will probably be one of the features of the contest.
So little is known abont the law that
a few.thousand copies distributed by
order of the Supervisors might prove
acceptable to taxpayers.
In Tulare county a suit has been commenced to test the law. Thomas V.
Cator, of San Francisco, is the attorney.
The Supervisors of Tulare on the 6th
of the.present month passed a resolution providing that on January 6th they
would proceed to appropriate from the
general fund sufficient money to carry
out the primary election in accordance
with the act of the last Legislature. It
is sought by Charles A. Spier, the plaintiff, to prevent the use of public money

the provisions of Section 1 of Article 2of the Constitation of the State of California, and is also contrary to Section
2% of Article 4 of said Constitution,
and is also for other reasons unconstitutional and void.
That notwit hstanding the unconstitutionality of said act, said Board of Supervisors threaten toand will uuless restrained by order and judgment of this
Court, proceed to appropriate money
from the general funds of said
county tocarry out the provisions of
said void act, and threaten to ‘and
will, unless restrained by order of this
court, proceed to purchase ballot boxes
at cost to said county of more than
$3000 for the sole purpose of carrying
on said primary election although said
county now has sufficient ballot
boxes toconduct all other elections both
of general and special, and the purchase of such additional boxes will be
an additional burden upon the taxpayers of said county without any benefit
to said county.
The plaintiff is without any ee
remedy at law, and that he and the
other taxpayers of said county are entirely remediless withcut the equitable
interposition of the court.
The plaintiff, therefore, asks that the
Board of Supervisors be restrained
from carry the primary law into effect.

Tue receipts from the new tariff law
now show an increase over the receipt
of the Wilson law at a corresponding
date last year. The Treasury officials
expect by the first of the year that the
receipts will be sufficiept to meet current expenses of the Gavernment. This
will be a novel experience to such
clerks as have been in the Treasurys
Department only since the beginning
of Cleveland’s last administration.
