A plainly written explanation of the now eléction law, particularly that portion govering primaries, would be appreciated by the mass of votes just now, says the Stockton Record. Some of the provisions are differently interpreted by attorneys, and, like something new cin generally be found by those looking for it. It is unders ood, however, that the Supervisors must appoint the judges uary, and, as the power rests solely with the Board, the committees of the political parties will have very littie tc do with it. The various party tickets at the pr:maries will be designated by color, the list of delegates of each party receiving the highest vote to be duly accredited delegates. The voter will have to be on the register, so that floaters will stand a poor show of getting ina vote. The efforts of various parties to hold their members in line and prevent outsiders getting in their work will probably be one of the features of the contest. So little is known abont the law that a few.thousand copies distributed by order of the Supervisors might prove acceptable to taxpayers. In Tulare county a suit has been commenced to test the law. Thomas V. Cator, of San Francisco, is the attorney. The Supervisors of Tulare on the 6th of the.present month passed a resolution providing that on January 6th they would proceed to appropriate from the general fund sufficient money to carry out the primary election in accordance with the act of the last Legislature. It is sought by Charles A. Spier, the plaintiff, to prevent the use of public money ‘SOME STRAIGHT TALK. meaning cannot be misunderstood, and when it thinks a thing it has the nerve to talk right out. These are two splendid qualities in a newspaper, and _ because the Tidings possesses them welike it from the ground up: That paper of last evening has the following, and it is worth reading. There are some people in Nevada City that it fits like an old shoe: “Our City Trustees seem verily to be between the devil and the deep sea. One class in the community says the shade trees which obstruct the rays from street lamps at night should be should be left standing to furnish reeded shade in the hot summer months. The latter class should use a glared war. against aLL shade trees, They will cat down only those which interfere with the light from the street iamps. The minds of some people are 30 béeclouded that they cannot see any‘hing proper in official actions. They pull back ifthe car of progress moves forward, and when they can’t stop the mule. It isa pity they cannot be stationed in the rear of their own class. Fortunately, however, this elemextt rarely gets into any position of public honor. His complaint That said act is unconstitutional and void by reason that it is contrary to the provisions of Section 1 of Article 2of the Constitation of the State of California, and is also contrary to Section 2% of Article 4 of said Constitution, and is also for other reasons unconstitutional and void. That notwit hstanding the unconstitutionality of said act, said Board of Supervisors threaten toand will uuless restrained by order and judgment of this Court, proceed to appropriate money from the general funds of said county tocarry out the provisions of said void act, and threaten to ‘and will, unless restrained by order of this court, proceed to purchase ballot boxes at cost to said county of more than $3000 for the sole purpose of carrying on said primary election although said county now has sufficient ballot boxes toconduct all other elections both of general and special, and the purchase of such additional boxes will be an additional burden upon the taxpayers of said county without any benefit to said county. The plaintiff is without any ee remedy at law, and that he and the other taxpayers of said county are entirely remediless withcut the equitable interposition of the court. The plaintiff, therefore, asks that the Board of Supervisors be restrained from carry the primary law into effect. “Jn spiTe of less active trade during October in most sections of the couutry, and the virtual stoppage of bvsiness at the South as a result of the yellow-fever scares and quarantines, the aggregate total for that month exceeded even Septembe~’s immense total, and marks the heaviest month’s total since January, 1883.: This result was accomplished, too,’with the same number of business days in the month as in September.”—Bradstreet’s. Tue receipts from the new tariff law now show an increase over the receipt of the Wilson law at a corresponding date last year. The Treasury officials expect by the first of the year that the receipts will be sufficiept to meet current expenses of the Gavernment.
