Some of the pa;ers are commenting adversely on the fact that a Downieville justice of the peace heard the argument of attorneys and rendered the decision on a Sunday in the matter of the preliminary examination of Richard Phelan, charged with murder. These papers think such action will invalidate the proceedings, but they are mistaken. A provision of the law permits the rendering of decisions on Sunday and other non-legal days, and as for the arguments, there is no law to prevent the lawyers from talking when and where themagistrate will listen to then.* other county organizations were formed as a basis for the California Miners’ Association, which is composed of representatives of the county associations. The membership has varied between 250 and 300 and has been largely composed of mining operators and commercial and manufacturing firms partly or wholly dependent on the industry. Some of these members have been quite prominent and active in the Miners’ Association and the presence there of. a few men not directly engaged in digging gold has caused a few quiet criticisms of the association by men not much interested in it. But the fact that business. men of high _ . Standing have taken an active interest in the State association isa lucky thing for the miners and is a key to the present movement.
