The Board of Trustees of the City of Nevada do ordain as follows : Section 1 Whereas, the Board of Trustees of the City of Nevada by ordinance heretofore duly passed by a vote of more than tWo-thirds of its members, ie “wy a unanimous vote, approved and published as required by law has determined that the public interest and necessity demand, and whereas the public interest and necessity to demand the acquisition of lands, water rights, rights of way, reservoirs and theconstruction and completion of a system of Water wo: ks that will furnish for the present and future an ample supply of"pure, wholesome water to protect the health, comfort, safety and best interests of the inhabitants of said City, and that the cost thereof is too great to be paid out of the ordinary annual income and revenue of said City ; and. Whereas, said Board of Trustees has deter mined and does hereby determine that. the assessed value of all property, both real and personal, in said City fortaxable purposes is the sum of $855,299.00 and thatthe annual tncome ind revenues of said City do not amount to more than the sum of $8000.00 ; and, Whereas, by resolution sald’Board did duly appoint and authorize F. M. Miller, Geo. L. Nusbaumer aud.W. F. Boardman, as Civil En gineers to make surveys, plans and estimates of said contemplated water works on behalt of and inthe interest of said City of Nevada, and Whereas, said Board of Trustees has hereto fore caused to be made by F. M. Miller, Geo. L. Nusbaumer and W. F. Boardman, plans and estimates of the cost of said contemplated public improvements, which said plaus and estimates were duly submitted to said Board and by them heretofore duly accepted and approved, ‘iter careful examination and consideration by said Board ; and Whereas, said Geo, L, Nusbaumerand W._¥F. That the public interest and necessities of the City of Nevada and its inbabitanta demand the acquisition, cuustruction and completion of such public water works Because in case of emergency, Section 5, That the cost of the acquisition of said prop tien and completion of ‘said reservoirs, is and will be too great to be paid out of the ordinary annual Income and revenue of said City of Nevada, and that it is necessary to lncuran in debtedness by said City iu the agyregate sum of $60,000.00, and to issue bonds of the said City to that amount to pay the cost thereof Section 6, That bonds of the City of Nevada of the erty rights, and things, and of the construc. — of said public improvements above infthia Ordinance set forth if the proposition to incur said indebtedness be accepted by two thirds of all the qualified voters, voting at said election, and said bonds will be issued and made payable so that ene fcrtieth part of the whole amount shall ke paid each and every year on @ day and ata place to be fixed by said Board of Irustees, together with the interest on all sums unpaid at such date at the rate of six per cent per cent perannum,’unotiithe entire debt shall be paid. ; Section 7 The special election herebycalled as aforesaid shall be held on : Monday, the 28th day of October, 1896, and shall be held and conducted, the votes thereat received and convassed, returns thereof made, and the result thereof ascertained and determined as herein provided, and according tothe law governing elections in said City of Nevada, and the polls of such clection shall be and remain open from sun-rise of the 28th day of October, 1895, to the hour of five o’clock in the afternoon ofjsaid day, whenthe polls shall be closed : Section 8. Notice of the said special election shall be published for not less than two weeks prior to said day of election, and after the final publi: cation of this Ordinance as hereinafter provided if at least one of the newspapers published in ~ said City of Nevada, in accordance with the terms of the statute in auch cases made and provided. Section 9. The ballots which shall be used at the said . special election shall be of the same character and form as those ballota used at other niunicipal elections inthe said City of Nevada, except as otherwise provided herein. Each of said ballots shall have printed thereon the following heading, to wit: “Municipal Ticket.”’ underneath which sbatl be printed the number of the precinctin which such ballotis to bevoted: underneath which shail be printed the following [words to wit: “Proposition for incurring an indebtedness by the City of Nevada to the aggrevate amount of $60,000 for the acquisition ot reservoirs, lands, rights of way, water rights, and all other things and rights whatsoever necessary for constructing aud completing ‘said water works, and constructing and completing the same,as set forth in Ordinance No. 128 Underneath this, shall be printed the following : “To vote for or against inourring said indebtedhess stamp a cross (X) to .the right of and against the answer which you desire to give.” Underneath which shall be printed in one Hine the following; “For inourring the indebtedneas,’’ to the right of which shall be prifted in one sqiiare the word Yea" with a blank square to the right thereof, and immediately be the same, in one line, the following: “For incurring the indebtedness,” to the right of which shall be printed, in one square, the word “No,” with a blauk square to the right thereof. Every voter desiring to vote in favor of the proposition of incurring the said indebtedness shall, in voting, stamp @ cross (X)in the blank square to the right of the word “Yes,” printed upon his ballot as aforesaid; and every voter desiring to vote against suid proposition shall, ip voting, stamp @ Ccrosa (X) tu the blank square to the” right of the word “‘No,”’ printed upon his ballot ag aforesaid, Section 10. The election precincts and the numbers and boundaries thereof shall be the same as those heretofore established, created and designated by the Board of Trustees of the said City of Nevada, and now existing therein.
