Waddell has a charge against me which did, and am here now to serve my 60 days’ sentence. The crime which I was convicted of was committed in 1885—the fall of the year—and had I money I could have cleared myself from this charge. This is only a plot of Mr. Waddell to show himself. Besides when this crime on Kneebone was committed I was in San Francisco getting ready to go to Truckee, and can prove that on that date I was in San Francisco, and on July 2d I was in Rocklin. On this charge Mr. Waddell don’t need to think he can trump anythingon me. He cannot get any clue as to my being in that vicinity at that time, as I have ample proof to substantiate myself in this matter. Mr. Wad. dell can do what he wishes but he must not think that the voters of Yuba county would ever nominate such a man for Sheriff, and he can crack his whip.
