TUESDAY. wv BARLY DAY DUEL of Honor. In a recent issue of the Illustrated. Ameri: can, Henry Austin, a well known writer, gives a very interesting account of ‘a due! that was fought near Marysville some fortytwo years ago between. men who’ were promtok A, in say ‘that it is inent then, fact those who have seen it, the best that has been published, that reason it is here reproduced in part. One of the thost curious of editorial duels The story is:‘well and for ' occurred in June 1853, about two milesfrom Yuba county. A witness of this literary encounter, who wrote years ago a clever account of it, called it ‘A. Clash Northern and Southern Pluck.” Between Felicitous title, surely, for if ever there were twogamecocks incarnated as men they were Judge Stidger, editor of the Marysville Herald, and Colonel Rust, editor of the California Express. Stidger was a Whig from Obio and Rust was a Southern gentleman with no very elevated opinions of Yankee courrage, For several weeks they conducted -a paper fightin which they applied to each other about all the epithets printable; but the admirers of the Judge claimed that he was the victor in vituperative verbiage, inasmuch as he said in, a minute more cutting things concerning his opponent than the others les= rapidly revoling brain could turn oft in a week, The Judge had that dangerous faculty-of seeing at a glance the weak spots and s\iking right there in such a way: that tse. wound rankled and festered with all the lingering venom of that kind of ridicule in which even the friends of the victim /can hardly refrain from taking a sort of mental] pleasure. In such a case and time and clime,’ of course, the conquering journalist would be invited to carry the quarrel into the field of honor, Yet it appears, and rather to the Southern Colonel's credit, that. at first’ he was disinclined to challenge the Judge, fee}ing that, as he had been the’ first to make the attack by pen, he had little to complain when he was worsted, But, as.usual politics was mixed up in the affair, and the party managers fancied there was a chance not merely to drive away Stidger but to wipe out the Whig paper, Stidger owned his paper and office outtit, lut he was in debt to Mr, Fall, who had enFall, quietly asked to make over the notes to men who, would press Stidger and’ force into financial distress by which it was hoped the Herald could be gotten into other hands and be made a Democratic organ, or else laid on the shelf. This piece of strategy failed. So the friends of Colonel Rust waited upon him, and told him that duty to his party, ought to prompt a challenge. likely they reasoned with him and themselves that Stidger, having come from Ohio, “where dulling was accounted a high crime and misdemeanor, would refuse, and then dGorsed notes for him, therefore . was Very social disgrace or ostracism would force him to sell out and quit the place. They reckoned without their host, In fact, Stidger was brave to the edge of folly, the brink of madiiess. He~accepted the challenge asif it werea bid to a wedding breakfast, and being entitled, according to the codes to choose the weapons and dectated the distance, he called for Buckeye rifles, and remarked that at sixty paces he could knock the tail off a squirrel in a tree, Judge Gordon N, Mott, Stidger’s chief second, and Colonel Charles Fairfax, a Vir-' givian, representiug Colonel Rust, searched far and wide for the weapons, butfaile d to find them, The only long-range guns ‘they find were a pair of Mississippi yagers, co suld and these, when tried by the seconds, proved to . ‘ be of unequal carriage ‘and conduct. Naugnt remained, then, but to cast lots. for “choice, and in-this procedure the better weapon wasd ‘won by the second of Colonel Rust, ‘It was now late on Friday, the very day of the challenge, and sunrise on Sunday was the hour appointed, the place being across the line of Yuba county where no officers of the law could interfere. Saturday night, however, word was brought to the Stidger party that Colonel Rust had suddenly been attacked by sickness and eraved the courtesy of postponement for a week, “A weak excuse and strategy,” said one Stidger’s friends who was somewhat of a wag, ‘just simply wants time to practice, Judge, He knows you are a crack shot.” Stidger smiled with the large carelessness of his temperament and said: ‘Oh! well let him have it; I won't kick.” “But your confounded weapon will’ thought Judge Mott though he said nothing beyond a courteous expression of : Mis principal's acquiescence in the postponement, Of course this turn of affairs gave time for the news .to4eak out, and by the following Sunday .the town of Marysville knew what was going to happen and the very place chosen. Hence, when the principals, with their two seconds and two ‘surgeons arriving on the scene they found cos hundred spectators auxiously awaiting the tragedy. = Mr, Austin here describes the battle which bad much that was huniorous running through it all, Judge Stidger appeared to their cS ‘ ft . ti of unease about him. . the seconds capitulated. In concluding the story of the affair he says : : Suddenly to the relief of the tension of gazing throng one of the seconds fired a yager in the air, Then everyone knew that the duel was done and that the seconds had arranged @ peace on terms honorable to both sides and with mutual bows the parties returned to their homes, : Fairfax nevertheless, used to remark that otten as he had officiated at meetings of this kind in the South, he had never. seen ‘men who stood up.more tinely than Rust and Stidger, and he ever after spoke in warm ton s of the Judge. ‘I confesg I had counted on his. wilfing, before the thing was over, since he was a Northerner not educated in the light of the But.there wasn’t a wilt or a shadow He took to the field, by God, sah, as if it belonged to.him, People-who tell me, after this, that men born in the North are cowards, will run the resk, sah, of my telling them they are asses. . know. better. Last week there were several mines bonded and sold, among them being the William Tell, Butte Saddle, Keystone, Roman, and a mine owned by Mr. Quirolo, There has also been a big strike made on the Cleveland mine. The owners have been prospecting this mine for five years and at last have been rewarded by striking a ledge in their lower tunnel, which is between thiry and fifty feet wide and prospec ta well.
