N ORDINANCE CALLING A SPECIAL
<\ election in the City of Nevada submitting
tothe qualified voters of said City at said clecon the proposition of incurring a municipal
indebtedness to the aggregate amount of §60,000,00 for the purpose of acquring lands, water
rights, rights of way reservoirs and other rights,
and things whatsoever necessary to cons ruc
and complete public water works for the said
City the cost of which wil be too great to be
pald out of the ordinary annual income and
evenve ofsaid City; providing for the issuane® of Bonds of said City to said amount for
said purpose; prescribing the time and manuer
of holding such election, and the voting for or
against incurring such indebtedness, aud otherwise regulating said election.
The Board of Trustees of the City of Nevada do
ordain as follows :
Section t
Whereas, the Board of Trusteas of the City of
Nevada by orditlance heretofore duly passed by
vote of more than two-thitds of its mem
bers, ice, by a unanimous vote, approved and
published as required by lew has determined
that the public interest and necessity demand,
and whereas the public interest and necessity
d>» demand the acquisition of lands, water
rights, rights of way,. reservoirs aud the construct.on and conipletion of a system of water
wo ks that will furnish for the present and future an ample supply of pure, wholesome water
to protect the health, comfort, safety and best
interests of the inhabitants of Bald City, and
that the cost thereof is too great to be paid out
of the ordinary annual income and revenue of
sald City ; and
Wheteas, said Board of Trustees has deter
mined aud does hereby determine that the as
sessed value of all property, both real and per
sonal, in said City for taxable purposes is. the
stim of $855,290.00 and that the annual income
and revenues of said City’ do not amount to
more than the sum of $8000.00 ; and,
Whereas, by resolution said Board dia duly
appoint and authorize FL M. Miller, Geo. Lb,
Nusbaumer and W. F. Boardman, as Civil En
gineers to make surveys, plans and ostimates
#fsaid contemplated water works on behalf of
and inthe interest of suid City of Nevada, and
Whereas, said Board of Trustees has, hereto
fore caused to be made by F. M. Miller, Geo. L
Nusbaumer and W.F. Boardman, plans and es
timates of the cost of said contemplated public
improvements, which said plans and estimates
were duly submitted to said Bowd and by
thom heretofore duly accepted and approved,
after careful excoriation and consideration by
said Board ; and
Whereas, said Geo. L. Nusbaumerand W. FB,
Boardman are each and all competent civil en
gineers who before doing said work have had
Successfulexperience ino such work as the
aforesaid contemplated puble -amproyements,
which facts said Board of Trustees has deter
mined and dows now unanimously adjudge and
determine hereby ¢ and
Whereas, it appears bysaid plans and esti
mates that the cost of such contemplated pub
Hie improvements will amount to $60,000.00 in
the aggregate, which amountis largely in ex
cess of the ordinary annual income and reve
pne of sud (ity
Now therefore, in consideration of the prem
ses, and in pursuance of the: acts, ordinances
and procecdings aforesaid; and of the Btatutes
in such Causes made and provided, a spectal elec
tion is hereby called and ordered to be held
and conduct: din and forthe City oi Nevada,
State of California, at the time and in the man
ner hereinafter fixed and prescribed, at which
special olection there shall be submitted to the
qualified voters of said City of Noyada to
be voted upon at said special election as
hereinafter provided, the proposition of
incurring an indebtedness by said City of Ne
Vada amounting in the aggregate tothe sum of
$60,000 for the purpose of acquiring lands, water
rights, rights of way, rese: volra and all other
tights and things whatsoever necessary for the
construction and completion of public water
works for the said City of Nevada,and con
structing aod Completing said water works
Section 2,
The objects and purposes for which the said
Indebtediuess is proposed to be incurred are as
followa : The acquisition by the sald City of
Nevada of reservoirs, rights of way, lands and
allother rights and things whatsoever, necessa
ry for constructing and completing public water
works for said City and its inhabitants, and tk
establish, complete and thoroughly equip a
system of public works therein with rerervolrs,
pipes, mains, laterals, and whatsocver thinge
shall be necessary therefor to supply said City
and its inhabitants with an adequate supply of

The estimated cost of the acquisition and
construction of said reservoirs, lands, rights of

whatsoever necessary therefor, aud of the
whole of suid pnblic improvements is as fol

The acquisition of said lands, reservoirs,
rights of way, water rights and all other rights

and the said covstruction and completion of

and requirements of said City, and that by no

Section 7
The special election herebycalled as aforesaid
shall be held on
:
Monday, the 28th day of October, 1896,
and shall be held and conducted, the votes
thereat received and convassed, returns thereof
made, and the result thereof ascertaitied and
determined as herein provided, and according
tothe law governing elections in gaid City of
Nevada, and the polls of such clection shall be
and remain open from sun-rise of the 28th day
Of October, 1895, to the hourof five e’clock in
the afternoon of said day, when the polls shall
be closed
Section 8. 5
Notice of the said special election shall be
published for not less than two weeks prier to
said day of election, and after the final publi.
cation of this Ordinance as hereinafter provided
in at least one of the newspapers published in
said City of Nevada, in accordance with the
terms of the statute in such cases made and
provided
Section 9. :
The ballots which shall be used at the said
special election shall be of the same character
and form as those ballots used at other municipal elections in the said City of Nevada, ex
cept as otherwise provided herein. Each of
said ballots shall have printed thereon the following heading, to wit: “Mumieipal Ticket.”’ underneath which sball be. printed the number
of the precinetin which such ballatis to bevoted

an indebtedness by the City of Nevada to the
aggregate Amount of 960,000 for the acqulstion
of reservoirs, lands, rights of way, water rights,
and all other things and rights whatsoever nec

the saine,as set forth in Ordinance No, 128. Underneath this, shall be printed the following :
