THE NEW LAW.
it Is Not Generally Understood by
the People.
The limitations on popular action found in
the new Rallot law, generaliy known as the
Australian; do not-seem--to— be generally
understood, Thecitizen who seeks to master
them will have to begin by fixing one date’
of the election, which this time will take
place on November 6th. From that date al]
the limitations are to be calculated. There
are fifty-nine days to the opening of the
polls. : ae
Regular parties which make nominations
for State officers must file them with th:
Secretary of State not more than sixty no:
less than forty days before election. _ This
duty will have to be performed on or before
the 27th of September, the current month.
. A-regular party is defined to be an organization which at the last election polled three
per cent of the total vote, or 8,000 votes iu
round numbers for the State. Independen:
nominees can secure wu place on the officia’
ballot ona petition in their favor of three
per cent of the electors, or 8,000 voters for
State officers, ‘as above set forth, Their
names must be filed with the Secretary ot
State, with the necessary documents, not
more than sixty days nor less than: thirty
days before the election. The latest dat«
for the performance of this duty will be
October 7th.
Independents have therefore the advantage of ten days or more over the regulars
The theory of the law is that independent
movements would not be started unless the
regular nominations proved generally dis—
tasteful. But those who object to party
rule in some branches of our Government
are not bound to wait till it has. been found
that the regular nominations would not suit
They can go to work now, but they must be
prepared to finish up and file their nominations with the Secretary of State on or
before Octeber 6th—one month hence, The
ten days’ e]bow-room allowed by the statute
is not enough to get up the nominating petitions and file nominations unless everything
_ is prepared. beforehead.« . The limitations on local political action
are identical with those presented in the case
of the State, but the periods are shorter. A
loca] party entitled to a place on the official
ballot for its nominees is one that polled 3
per cent of the local vote at the last election.
Its nominations must be filed with the
County Clerk not more than fifty nor less
than thirty days before the election. The
latest date for the regulars for the perform_ nee of this duty will be the 7th of October.
It is not expected that the convention of
these parties can be held much before the
latter part of the current month, which will
leave them a week or so to finish up. Independent local movements are allowed
more time, as already stated, than State
conventions, . They will have ten days after
the filling of the nominations of the regulars
to take action, :
The nominations of the latter must be
filed with the County Clerk not more than
fifty days, nor less than tweuiy days, before
the election. This last date will le October
17th; but if all the work of an independent
movement is thrown on these ten days of
additional time over the regu ars, it cannot
be performed with any degree of success.
To crowd into that brief-period the signing
of the necessary petition and the making
and filing of nomiuations would require a
great deal of political nimbleness, The
Non-partisans, however, do not need any
petition, They polled more votes at the
last election than are necessary to give their
nominees a place on the State ticket,

THE HARTLEY TRIAL,

At the conclusion of yesterday’s examination Alice M. Hartley was called to the
stand.
She spoke very affectedly and in some
instances very dramtically.
She broke down several times and sobbed heavily.
In substance ghe testified as follows:
I am a widow, my husband having died
in 1892. Iam 4n artist. I came to Reno
in search of health. ;
«I met Mr. Foley about October 14th; went
tv Nevada Block with Mra. Hunt to rent &
room for a studio. In the early part of December I sent for Mr. Foley to see about the
gas fixtures.
While he was in my room on that errand
1 showed him some specimens of gold from
iny mining property at Meadow Lake in
Nevada county, o
Afterwards he sought an interview with
me, saying that Senator Jones was coming
out here, and he would interest him in the
property.
I made an appointinent with Mr, Foley
to give him the papers relative to the mine
at my room on that evening.
I requested the janitor of the bank to
call at my room that evening, at the same
t.me for letters. :
He did so, but having been busy talking
the letter ready.
Mr, Foley stayed quite late, and I said, I
am sorry I have no refeshments to offer you,
save milk and brandy,
He took a sip of the latter. 5
At half-past 9 o’clock on the evening of
January 30th I heard a hard knock at my
Senator Foley, who said that. he must have
the papers relative to the mining property
as Senator Jones would be here the next
day. ;
I said I would bring the papers down to
the Bank the next morning.
He-asked me to go out to supper with
him. I replied that I could not thitik of it,
He then asked me for,some brandy, as he
was cold. He insisted wpon having the pa~

the papers, he poured out two cups .of
brandy. He insisted that I should drink
with him, I refused, but he insisted, saying he would leave as econ as I complied.
I took a sip and said, now go. He replied that when I drank it ull he would go.
I did so, and almost immediately I had a
most peculiar sensation, accompanied by
dizziness and nausea,
I fainted away and on recovering found
that he had accomplished his purpose.
I begged him to leave me and he refused.
I again fainted,
He stayed until 5 o'clock the next morning.
He came again the next evening and I
told him that if he ever mentioned what had
happened on the previous night what I
would do. _
Fearing, from feelings of indignation,
that 1. would lose control of myself, I kept
my pistol locked up ina trunk,
On the night of February 26th on going

Mr, Foley stepped out of his shadow by
the lolding doors, After trying to reach
the door Mr, Foley overpowered me and
again I lust consciousness,
In March I went to’ San Francisco,

tained my condition and told Mr. Foley,
Mr, Foley advised me to go to Dr. O’Donnell in Saa Francisco and be relieved of
the child,

dropped the chair, and said: ‘That settles
me, It has gone right through me,”

court took a recess, the rigid cross‘examination by Hon, W. H. Woodburn had not
been-able to shake her testimony in the

It is the general belief that she will be
