Granting to Nevada Counfy Traction Company a franchise to construct aud operate‘a street railroad along ~ and upon the.County Road between the corporate limits of ‘the City of Grass Valley and the corporate lim. its of Nevada City, by way of Town Talk, in ssid Nevada County. Board of Supervisors of the County of. Nevada do ordain as tollows: SEOTION 1. SECTION 2. The ties and rails of said railroad and all turnouts and switches shall teso placed as to afford no unnecessary obstruction to travel on such County Road, ard the same shall beso located on such route as shall be directed by, and to the satisfaction of, the Supervisors of the first and second supervisoral districts of said Nevada County. If the said Read shail be operated by electric ower, the same shall be operated by overRead trolley system, and the poles carrying the power current shall be set ina safe, substantial. and workmanlike manner, and shail be sufficiently removed from the trayeled part of said road so as not to interfere with the travel thereon, and wires shail be strung on said polet in a manner to prevent their coming to the ground. SECTION 3. Thesaid grantee and its assigns shall paye or macadamize the travel part of sai County Road between the rails, between the tracks, and for two feet each side thereof, with the same material used by the County, upon the highways over which the road runs respectively, and keepthe same constantly in repair, flush-with the highway and provided with suitable orcssings; and shall make the road bed conform at ali times to the established grade of the said highways; all repairs and grades to be made under the instructions and to the satistaction of said. Supervisors of the first and second supervisoral districts. an case the said grantee or its assigns fail to comply with the instructions given by said officers for ten days after service thereof upon the agent of said grantee, resident in said Nevada County, the said Supervisors. or their employees, may enter upon the road of said grantee and do the work as ordered by said Supervisors; said Supervisors to keep an item. account of the cost of said work, which sai Fb ng by theacceptance of thisfranchise hereby agrees to pay immediate upon its presentation to = grantee’s local agent stationed in said Nevada County. * SROTION 4, Cara shall be run over the road constructed under this franchise during every day, unless prevented by the elements or unavoidable acsidents, or for reasons over which the grantee has no control. Provided, further that cars shall be operated upon said lines at intervals of not more than one hour between the hours of 7:80 a. m. and 9; 80 p. m. each and every day, unless prevented by the elements or unavoidable accidents, or tor reasous over which the grantee has no control. SECTION 5. The said grantee, and its assigns shal construct all necessary flumes and culverts for the free of water under the tracks of said railroad, where the same naturally Hows; and all carves, aqueducts turnouts and switches shall be constructed under the plans and fications approved by the Supervisors of the first and second SECTION 6. The County of Nevada, in making the qrant of ¢ franchise, expressly reserves theright to tt ay macadamize, renew or sewer any of said highways, or to lay gas, water or other pipestherein, such work to bedone s0 as to injure said railroad as little as pessible. , SECTION 7. SECTION 10. This franchise and right shall continue for the term of forty-nine (49) years from the date of the final passage of this érdivauce.
