ORDINANCE NO. 74.
Granting to Nevada Counfy Traction
Company a franchise to construct
and operate a street railroad along
and upon the County Road between
the corporate limits of the City of
Grass Valley and tne corporate limifs of Nevada City, by way of Town
Tatk, in sxid Nevada County.
The Board of Supervisors of the County of
Nevada do ordain as follows:
SHCTION 1.
The franchise and privilege is hereby
granted to Nevada County Traction Coimpany, its snecessors and assigns, to construct and operate a_ street, railroad
along and upon the County road _between, the corporate limits of the City of
Nevada and the City of Grass Valley, by way
of Town Lalk, in said Nevada Couuty, said
railroad to be operated by either electric
power, steam power, power derived from
compressed air, liquid air, underground
cable, horses, mules or other approved
method of transportation, over and upon the
following route:
“Commencing on the eastern boundary
line of the corpo: ate limits of the City o!
»orass Valley, at the junction of Main Street
and the Grass Valley and Nevada City turnpike; thence along the Southerly side of
Grass Valley aud Nevada City Turnpike to
the Idaho road; thence curving Northerly
to the Westerly side of the Grass Valley aud
Nevada City Turnpike; thence Northerly
along the westerly tide of the Grass Vailey
and Nevada City Turnpike to the Southerly
line of the property of Roger Shackleton
and Charles Shackleton; thence leaving the
CouatyRoad, Northerly and Easterly
through and upon private property, by ard
with the consent of the owner, to the Northerly side of the old Hughes road; thence
through and upon private property, by and
with the consent of the owner, to a poipt
sixty-eight (68) feet Southerly from the iron
tence in front of the residence and property
of Richard Noell, intersecting the County
_Road ; thence ere tyrone A along the Northwesterly side of the Grass Valley and Nevada
City Turnpike to a point opposite Glenbrook
Park; thence again leaving the County
Road, curving Northerly into and upon private property, by and with the consent of
the owner, passing through and upon same
on such courses as may afford a practical
ratie for the operation of cars to Town
Telk;thenec along the Northwesterly side. of
the lower Grass Valley and Nevada City
furnpike to the Southerly boundary line of
the corporate. limits of the City of Nevada.
Said railroad to consist of either single or
doub'e track, with necessary turnouts and
switches; provided, however, that in no
case shall a double track or turnout be laid
on said. County Road, where said road is not,
at least forty feet in width. E
SECTION 2.
The ties and rails of said raijroad and all
turnouts and -switehesshall Leso placed as
to afford no_ unnecessary obstruction to
travel on such County Road, ard the same
shall beso located on such route as shall be
directed by, and to the satisfaction of, the
Supervisors of the first and second supervisoral districts of said Nevada County. if
the said Road shal be operated by electric
ower, the same shall be operated by overhead trolley system, and the poles carrying
the power current shall -be set in a safe, substantial. aud workmanlike manner, and
sha'l be sufficiently removed from the traveled part of said road so as not to interfere
with the travel thereon, aud wires shail be
strung on said poles in a manner to prevebt their coming to the ground.
SECTION 3.
The said grantee and its assigns shall pave
or macadamize the travel part of said
County Road between the rails, between the
tracks, and for two feet each side thereof,
with the same material used by the County,
upon the highways over which the road runs
respectively, and keepthe eame constantly in
repair, flush with the highway and provided
with suitableercssings; and shall make the
road bed conform at ali times to the established grade of the said highways;
all repairs and * grades to be made
under the instructions and to the
satisfaction of said Supervisors .of the
first and second supery soral districts
in case the ssid grantee or its a‘signs fail to
comply with the :nstructions given by said
otficers for ten days after service thereof
upon the agei.t of said grantee, resident in
said Nevada County, the said Supervisors
or their employees, may enter upon the road
of said grantee and do the work as ordered
by said Supervisors; said Supervisors to
keep an itemized account of the cost of said
work, which said grantee, by theaccep' ance
ofthisfranchise hereby agrees to pay immediately upon its presentation to said
grautee’s local agent stationed in said Nevada County.
SECTION 4,
Cars shall be run over the road constructed under his franchise dusipg every
day, unless prevented by the elements or unavoidable accidents, or for reasons over
which the grantee has no control.
Provided, further that cars shall be operated upon said lines atinteryals of not more
than.one hour between (he hours of 7;30_a.
in and 9:30 p.m. each and every day, unless
prevented by the elements or unavoidable
accidents, or tor reasous over which the
grantee has no control.
SECTION 5.
The said grantee, and its assigns shal
construct ail necessary flumes and culverts
forthe free passage of water under the
tracks of said railroad, where the same
naturally flows; and all curves, aqueducts,
turnouts andswitches shail be constructed
under the plans and specifications approved
by the Supervisors of the tirst and sécond
supervisoral districts aforesaid.
SECTION 6.
The. County of Nevada, in making the
theright to pave, macadamize, renew or
sewer any of said highways, or to lay gas,
water or other pipestherein, sueh work to
be done so as to injure said railroad as
little as péssible.
SECTION 7.
Provided, further, that the cars upon said
road shall not be allowed to stand on the
highway, or highway intersections iu such
&@ manner as to obstruct the use of said highways by vehieles.
SECTION 8,
That the rate of fare, one way, for any distance along said road, or along said road
and any connecting line or lines leading to
or into the City of Grass Valley, or to or tac
the City of Nevada, in said County, and
. operating under said franchise, shall not exceed fifteen cents for one passenger.
SECTION 9.
Werk shall be commeiiced by said grantee
. or such work shall be actually under way
. within the period of ten-days from the final
. Passage of this ordinance, and work shal! be
. completed upon and slong said route within
a period of three months from the tinal pas. sage of this ordinance.
SECTION 10.
This franchise and right shall continue for
the term of forty-nine (49) years from the
. date of the final passage of this ordiuauce.
. SECTION 11.
. This franchise is granted subject to.a
. special privilege heretofore granted to John
. Martin, by ordinance numbered 69, passed
by this Board on April 2, 1901,
This ordinance sball take effect and be in
force on and after teu days from the date of
its passage.
