The first habitation of a white man within: the bounds of Nevada City township was built at Gold Run in September, 1849. It is reputed that James Marshall, while leading a party of emigrants to Sutter’s Fort in the summer of 1848, camped@n Deer creek and there panned ‘color.’ . Captain John Pennington, Thomwho found rich diggings in Gold Run and built a log cabin not far from the southern end of the present Pine street bridge, In October, 1849, Dr, A. B. Caldwell, who a few months before set up a little trading post seven miles down Deer creek, came up to Gold Run and finding . miners working there and in the ravines which converge the Broad and Main opened a store on the site upon which the Washington public school Was later built and is now occupied by ‘Trinity Episcopal church. A Mr. Stamps, accompanied by his wife, her sister and several children, was the first family to settle in this community. The only other woman who passed the winter of 1849-50 here was Madame Penn, who worked a) claim with her husband, and in the spring opened Nevada City’s first boarding house, JOHN BENNETT HANGED . Little is known of his early life. He was believed to’ have) served with the U. S. army in the} Mexican war and to be an escaped or discharged convict from a British penal colony. He had been branded with the letter R. Bennett was warned to leave town following the pistol stealing affair, but a few days later $357 worth of gold silver was stolen from a Stocking Flat miner. Bennett was suspected and when apprehended in Newtown he_ had the exact amount of the stolen valuables. He was summarily’ tried by a miners jury, sentenced to fifty lashes and warned not to return to Newtown on pain of death. The following night a number of cabins at Coyoteville were entered and robbed. Bennett was captured and on his person was a. watch and chain and several other articles indentified as stolen from Coyoteville cabins. He was promptly indicted by a grand jury. Nevada County Judge Thomas Caswell and several attorneys advised Bennett to plead guilty to the Coyoteville robbery and take a jail sentence rather than risk hanging for the Stocking Flat robbery. When he appeared in court his. attorney for some reason never explained entered a plea of not guilty and Bennett was tried on both charges.
