"Finnegan. stated he was ready to proceed with his argument ¢#hen and there, but Judge ‘Snell thought it would be better for eounsel to look up their legal authorities and make their arguments before him Thursday morh_ Jesse H Strickland, resort own-er at Hirschdale was a brief witness following Sheriff Richard W. Hoskins yesterday afternoon. He identified the defendant as having bought a glass of ‘Seotch whiskey in his bar about te sgh on the day of the McLain murder. Next came Leypoldt, whorecited. the circumstances under which the confession of Lois and Joe Hardy were contained on Sunday, August 8rd in the Las Vegas jail. Rev. Craig Willoughby, as was customary he said, gave church services for jail inmates on ‘Sunday afternoon. The Rev. Willoughby, following the service, acccording to Leypoldt, told him he wanted to talk with. Lois and Hardy in the jailer’s office. This request was granted. He sent for another deputy sheriff, A. H. Kennedy, who arrived a little later and then went into the room with Lois and Joe Hardy and the Rev. Willoughby. Leypoldt said that Joe did most of the talking but was oceasionally corrected on some detail by Lois. Leypoldt said he took down their statement in long hand and then had it typed. Joe Hardy signed it, and then He and Kennedy, and finally Lois. The statement was written in the first person, singular, and for this reason was not admitted to the Lois Hardy trial. Thursday Session Judge James Snell was asked Thursday evening by: District Attorney Vernon Stoll to admit—in evidence a long hand printed document legal sized yellow ruled paper, in the trial of Joseph Hardy, accused of the murder of James W. McLain last July 31st, dismissed the jury again, and said that he would hear legal argument prior to the court’s convening this Nevada City, Calif.
