BEAR RIVER LAW SUITS HAPPILY THINGS OF PAST With the directors of the Nevada Irrigation District voting four to one Thursday morning to drop the condemnation suits on the Bear river and thus ending the conflict with the Pacific Gas and.Electric Company, things are rapidly assuming a brighter hue with the financial affairs of the District. Those voting to end the squabble with the: power company which has been tying up the prospective revenues of the District, were Directors Teagarden, Schwartz, Muleahy and Robinson while Ullrich preferred to stick with the Wisker ship to the last. The pronunciamento of State Director of Banks Will C. Wood that the District tion to work with the power coming the decision of the directors to were called into conference with Mr. Wood on Tuesday in the city and his public statement to the press followed. The statement which is a lengthy one would be republished here but ‘for lack of space. However the highlights of Mr. Wood’s statement are as follows: : He states that there have been three points of controversy—the filing of the condemnation proceedings by the District was the most vital one, the sips es the matter of the contract for the delivery of water and the third was the matter of ‘the 135 feet of water to be delivered to the Company at Spaulding and thence through the Drum eanal for pickup at the head of Bear river canal. The major portion of the water which the District filed on in 1922 was flow from Lake Spaulding effected at great expense by the power company with the intention of using it in a series of power houses along Bear river including the 16 mile streteh which the District was attempting to obtain under eminent domain proceedings. -The District held that the failure of the company to make beneficial use of the water in the 16 miles, .was technically an abandonment of the water. The company has held that there was no such abandonment, ‘that it had been using due diligence in protecting. its rights and that it has from time to time been acquiring rights the Bear river and has been planning of extra power houses to utilize the full power and on possibilities of the river. “Value Inflated” “The success of the district in any effort to establish such rights is at In consequence the district does not stand to lose $7,000,000 if the directors waive their filing; the only thing the district will lose is a fairly remote chance to acquire the rights it has claimed. The directors held a hurried meeting Thursday morning, voted to dismiss the condemnation suits and adto meet this morning at which time it is expected that both Mr. Wood, Attorney General Webb end the representatives of the bond syndicate to work out some solution of the pressing financial preblems ‘of the district. SHould this be accomplished in a menner to insure the future well beof. the district, those misinformwho thought starting a recall would Wisker throne again, will be busy explaining their actiofis to the public generally. It is not considered further reeall proceedings will be instituted ogainst the other three directors and from the rising tide of indignation of pulling the recall at such a critical stage in the district history, is likely to prove a decisive boomerang for the few remaining Wisker cohorts in attempting to regain control of the board of directors. Joe Marriott is in charge of the shaft work. Three shafts sets were completed to Saturday night and the work will be pushed until a depth of 200 feet is reached. Olsen, superintendent of operations for the Yakima Mohawk Mining Compe~y opening up the property was called to Washington on business the past few days but is expected to return this week. In addition to the Ben A. and C. F. Bost and the Teale holdings of 105acres, the company has also taken over the Lotz mineral rights the past week. A sample of the granite formation encountered in the shaft and showing a peculiar deposit of sulphides and galena in its surface is on exhibit in The Nugget windows and is creating a great deal of interest mining men. JACK HORWEGE PASSED AT M°CLOUD YESTERDAY Jack Horwege, anative of Camptonville and well known among throughout this section passed away at 11 0’ cleck yesterday morning at McCloud, Shasta County. SHERIFF CARTER GETSPRAISEFOR CAPTURE LEUNG Sheriff George R. Carter has been receiving. congratulations from widely seattered points for his closing in on California’s greatest murderer ‘n the state’s history, when he apprehended Leg Ying in an old tank near the early Thursday morning after night of search. The driver was recognized as a Grass Valley Chinese and the stranger behind him was not spotted at the time as the killer, not resembling apparently the description which had been broadcast by Sheriff J. R. Thornton of Salano County. Carter narrowly escaped death at fhe hands of the assassin at the time and only -a momentary fear on Leung’s part kept him from turning his concealed, weapon on the sheriff. Leung had his gun pressed against che driver at the time to keep his mouth shut. Later in the night Car-ter took up the search of every place ‘n both communities frequented by the Celestials and about 6:30 in the morning came onto the old tank house on the Dick Bennallack place. Pushing in the’ door he found the killer lying on the floor but made no move to defend himself. Carter however was taking no chances and with drawn gun took Leung into eustody,.; lodged him in the county jail and notified the Solano officers. Leung admitted his guilt and gleefully announced that he was “better man: than Tanko Hall.”’ He had a hypo needle concealed on him and was later found in his cell giving himselfa little shot. On him was found a small black. a piece of cake bag containing reported poisoned and which Leung claimed had been which he said was the motive for the wholesale killing. He also hada sawed off 25-35 Winchester with which he had done a portion of his fiendish work. He had over $100 in money on him..
