March. 4th, 1947 at 2 ° clock P. The pr pROPOSED NEVADA COUNTY SLASH AND MILLWASTE DISPOSAL ORDINANCE ii a OR, (IN 1: it shall be the duty of the owner of the land in Nevada or in any person in control of any such land, or of any agent, emJoyee contractor, subcontractor, lessee, licensee, or tenant of the owner gets such land, upon which the cutting of lumber products, including seine timbers, sawlogs, veneer blocks, piling, posts, shakes, shingle fire wood, or any other operations ciuttine tjmiber products that reaccumulation of inflammable debris in Nevada County outside of any incorporated area, hawe been carried on, or shall hereCounty, sult in the the limits -jnafter after provided. : 2 mh Ss No such operations as set forth in Section 1 shall be conducted in any area, unless such area shall have been apportioned into one or more interior plots not exceeding twenty acres each and one or “more marginal strips having a width of at least one hundred feet each and which marginal strip completely surrounds each such plot and completely separates same from any State Highway, County Highiway, or Federal or State maintained roadway, that adjoins any such land. SECTION 3: All such operations as set forth in Section 1 shall be conducted in the following manmner.All dead trees. standing more than fitteen feet in height and having a diameter of more than twelve inches measured at four and one-half feet above ground level shail be felled at time of cutting operations. All living or dead trees that had been felled during such operations, including all logs, tops and other portions of such trees, shall be lopped by detaching therefrom all brush and limbs of usable 3 portions of tree. All accumulated inflammable debris shall be prepared or processed as follows: : (a) Within said interior plot: By being scattered on the ground so that no portion thereof shall be higher than five feet above the ground, and (b) Within said marginal strip: By béing gathered and piled. No pile exceeding five feet in height above the ground or sixty-four square feet in area, nor shall be less than tiwenty-five feet from any other pile or less than fifteen feet from any standing timber having a diameter of more than six inches measured at four and one-half feet above the ground level. SECTION 4: As an alternative in lieu of the Procedure set forth in = oo 2 o 2 in the following manner: having a diameter of more than twelve inches measured at four and one-half feet above ground level shall be felled at time of cutting operations. (b) All living or dead trees that harve been felled during such operations, including alll legs, tops and other portions of such trees, shall be lopped by détaching therefrom all brush and limbs at the time of limbing of usable portions of the tree. (c) All accumulated inflammable debris shall be gathered -and piled. No pile shall excéed five feet in htight above the ground or sixty-four ‘square feet in area,, nor shall be less than twenty-five feet from any other pile or less than fifteen feet from any stan4ine timber having a diameter of more than six inches measured four and one-half feet above a ground level. : SECTION 5: Within thirty (30) days after the felling or falling of any tree, all accumulated inflammable debris shall be scattered or gathered and piled de set forth in Section 3 (a) and 3 (ib) or gathered and piled as set forth’ in Section 4 (c) above: eae ‘ SECTION 6: All-inflammable debris accum : of Section 3 (b) or 4 (c) shall be disposed of by burning in accordance with the provisions of Section 4153 of the Public Resources Code of the State of California, or any amendment or amendments thereto. provided that in any event, all inflammable debris accumulated in accodance with the provisions 0 Section 3 (b) or 4 (c) shall be disposed of by burning on or before the 15th of April of each year. ., . ; SECTION 7: “Inflammaible debris’’ as used in this ordinance is here. by defined to be any slash, brush, limibs or portions of limbs or trimmings, which are less than four inches in diameter and the bark resulting from the peeling of any timber. : : "SECTION. 8: It shall be the duty of the owner of any-land in Nevada ‘County, or of any person in control of any such. land, or of any agent, employee, contractor, subcontractor; lessee, licensee, or tenant of the owner } of any such land, upon which the processing of timber products including ‘zough lumber, planed lumber, shingles or any other ‘processing operations that result in the accumulation of processing waste im any area in Nevada ‘Mounty outside of an inco ated area have been or shall hereina‘te be ‘faified on to conduct such operation in the manner hereinafter provided.
