CLOSED SHOPS MAY BE OPENED BY WAGNER ACT The following letter which anpeared in the Sacramento Bee is ot interest to all those interested in the Wagner Labor Relations Act: “The United States’ Supreme Court has upheld the Wagner Labot Relations Act in its general application to manufacturing. However, $55 a month and maintenance, ages 21 to 50. Experience as a telephone operator required. : Janitor (men only),.$100 a month ages 25 to 50. Janitorial experience required. (To be given in San Francisco only. ) June 26 (Applications must be filed by June 19): Publi¢ Information Editor, San Francisco-Oakland Bay Bridge, $225 a month, ages 25 to 50. Newspaper or publicity expereach independent employer must at 3 ience required. some time apply its privileges and prohibitions to his own with hisy-employes. “Tf his has been a closed shop . that is operated exclusively by union labor, under agreement with a recognized group, he may, upon labor unit, enjoy the hiring whomsoever he may choose, regardless of the -worker’s union status, for nowhere in the law can be found the demand or implication that.any employe shall pay dues, fees, assessments or render service to any church, lodge, political party or golf club. as qualification for employment. “The law protects employes in their right to collective bargaining if they so elect and lends assistance te such deliberations through the National Labor Relations Board. And by the same token, it religiotisly defends the independent employer-employe relation of the group that prefers to continue under mutual satisfactory arrangement. Their desire to do so may bbe legally expressed by merely refusing to join in any movement for collective bargaining. “Mistaken or over’ enthusiastic labor agitators are tryine-to create the false impression that the law or the government requires the adoption of the closed shop principle, but employers are assured that unless an actual majority of the workers in a shop, plant or department are in favor of holding an election to choose representatives to deal with the employes no such’ election will be held by the regional office of . the National Labor Relations Board. “Should the majority group represent and bargain for the minority group, workers in such minority group may still remain free from membership, payment of dues, fees or assessments in any union or association, unmolested in their privileges as employes. Continuity of employment does not rest upon the affiliation or non-affiliation of the worker with any labor union. This leads one to the conclusion the supreme court has theoretically opened the closed shop.” (Signed) PAUL D. NEFF.
